The driver in front of me was driving in the middle(more towards the wrong side) of the road. He suddenly turned left into a drive without indicating and banged my back door. Its quite hard to explain but as he got out he apologized, said he hadn't seen me and accepted responsibility. Since then my insurance company have said he's blamed me. I can understand how they could assume it was my fault but i have only spoke to them over the phone and would like to show them how it happened to determine if its my fault. I risk losing 3yrs no claims so would be grateful if anybody can help. Thank you

I WAS THE PASSENGER IN AN AUTO ACCIDENT ON FEB 6TH I HAD SWOLLEN KNEES AT THE TIME. HOWEVER, I DID NOT SEEK TREATMENT UNTIL FEB 9TH. I OBTAINED A LAWYER ON THE 10TH. THE DRIVERS INSURANCE CARRIER CONTACTS ME ON FEB 18TH INDICATING THEY HAD JUST BECOME AWARE I WAS IN THE CAR FROM THE DRIVER. I JUST FOUND OUT I AM NOT ON THE POLICE REPORT MARCH 10 FROM MY LAWYER. I HAVE BEEN IN PHYSICAL THERAPY SINCE FEB 10TH. WILL NOT BEING ON THE POLICE REPORT HURT MY CLAIM... Would the 2010 Civic typically cost more to insure that the 03 Accent?

My 2001 Subaru RS was recently involved in a frontal collision. I obtained the car in 2003 and had a new clutch put in under warrenty. The car had a major service 6 months ago and no problems or wear and tear issues were reported in regards to the clutch or surrounding areas. On 19 Feb 2010 we were stationary on a hill with a decline of approximately 25 degrees facing down the hill. Both the foot break and clutch were pushed all of the way in. A 2008-2009 Toyato Camry that was approximately 20 meters in front of us reversed up the hill at approximately 20-30km per hour and hit the front of our car, we have estimated the force of impact was around 30,000 newtons. (L driver.... we weren't expecting it either!) There was no panael damage on my subaru - the entire impact hit my number plate, the Camry had some marks on the back where it had hit. The hit was enough to give me whiplash and pop a rib out. Within a few minutes of driving the subaru after the accident we noticed a strange noise and felt like the clutch was slipping. We rang the insurance company straight away who sent us to a panel beater (helpful) who couldn't help and so took it upon ourselves to get the car to an actual mechanic. The mechanic said that there was definately something wrong. Within a couple of days and various phone calls bewteen the insurace company and the mechanic the subaru had become undrivable. We managed to get the subaru back to the mechanic on Monday who pulled everthing apart and found damage (forgive me I'm not too sure on mechanical components) to the flywheel - something that surrounds the clutch? The said that the damage could have been caused in an accident but couldn't proove 100% that it was caused in an accident. This finding was reported to our insurance company. The assesor from our insurance company (a panel beater by trade) went to have a look at the damage today. In his opinion he said that the damage was caused by wear and tear and that there is no way that the accident caused it. He said that it was just an "incredible cooincidence" that the accident and the flywheel damage occured minutes apart from each other. I'm just wondering if there's anything I can do? I feel gutted that through no fault of my own I am now without a car and will be for quite some time ($1,500 to fix - ouch). I thought that's why I was insured - to protect myself from headaches like this! All advsise welcome. Thanks.

A car collided into me while I was making a left from a parking stop. I looked over my shoulder twice, didn't see it, and i briefly looked at my back camera for a second or two, checked my mirror for the last time, proceeded to turn left and then it was too late some grandma comes out of the blue (she made a left on a street perpendicular to me, really fast) and she hit the front left of my car. Her car was pretty intact other then a dent on the right side of her car while my car took the worst of the blow. My front bumper is pretty much gone, although everything else is fine like the axle and engine. Regardless I feel like shit. I've never been in any accident ever since having my license and little over two years I got an Acura TSX my first car...and I mange to fuck everything up. My insurance will probably skyrocket to $2000 if not more. It's ridiculous. it just really sucks right now...sorry for the blggish rant I just feel really depressed

My husband was in an accident in September 2008. A million phone calls later in early 2009 our health insurance (secondary to the auto insurance) had overpaid the ambulance company. In February 2010 our health insurance apparently has taken the money from them because they haven't received information on them being the secondary insurer and the ambulance company has billed us for the entire amount which is almost 900 dollars. Is this even legal?? The payment is due immediately and I'm sure they will take us to collections soon. Please help! I forgot to add that in early 2009 our health insurance company AND the service providers (ambulance, hospital, etc.) all told me to wait. This is the first thing I've seen on it since then. I realize I'm responsible for our medical bills that we've incurred...and we pay for them. However, this bill reflects the full charge of the ambulance service and no payments from either the car insurance company OR the health insurance company. Health insurance paid them, then took it away, then informed me that they (the ambulance company) can't do that.

Hi. Last Saturday I stupidly came around a curve to fast and swerved to hit a deer. I know better, but kind of instinctively did it. My first reaction was just too swerve. After that its kind of a blur. All I really know was that I ran over a mailbox. Both my airbags deployed, car wouldn't start, windshield was cracked, fender was bent. I talked to the guy that owned the house, he said he just wanted to have the mailbox replaced and that he would call us soon telling us the price for a replacement. I had the car towed the next day. Its been 4 days and I still haven't heard from him. It turns out my car is pretty much totalled and would cost alot for all the repair. The police where never called, and neither where insurance companies(all i have is liability). ISo my question is what do I do from here? Was it mandatory that i was supposed to file a report? What steps do i need to take?

I was recently in an accident. Basically the other driver was determined to be at fault, he is covered by Progressive. The total I have to pay to fix the car is $7200. Progressive is telling me they will only cover up to $5000 because in Pennsylvania that driver had only up to $5000 collision coverage on his insurance. Going through my insurance is not an option because first of all my rate would go up and secondly there was an issue with me being excluded from my parent's car which I had no idea about. Anyway, can I pursue this and make Progressive cover the whole damage on my car or are they only liable to cover up to what the other driver has on his insurance policy?

Hi there, I'm SO close to buying a Ford Escape (2010) that I thought I would ask some opinions of people who already have them. Firstly, do you like it, secondly, was it worth it, and lastly, if you could have chosen any other vehicle over the Escape, which car would it be? I have a 2003 Ford Mustang Convertible Pony Edition with only 55,000 kms on it, and I went to the Canadian Blue Book web site to find out how much it was worth and got a price that was about $2,000 lower than what the dealer offered me if I traded it in. This Mustang is my first car, and it's never been in an accident and it's got a clean record. With that in mind, how do you get over the sentimental attachment to an object you value? I'm going to find it extremely difficult to let go of the Mustang, but if it's going to save me a bundle on a trade in, then I shouldn't think twice about letting it go. I've had the Mustang for almost 7 years now and although it's nice, it's not very practical and insurance is a killer ($3,100 the first year, $2,900 the following year, coming down with each accident-free year). What's insurance like on the Escape? I hope it would be considerably less because it's a) not my first car and b) not a sports car and c) I'm not a first-time car buyer now. It's been paid for for years, and I take excellent care of it, and would do the same with the Escape if I buy one. I think I need some advice... any of you Escape owners out there have anything good to say about it? Thanks! Dan

A drunk woman hit my sons car - the case is still in court. Her attorney has told them not to give the information out. I would love to report him to the bar if this is illegal This happened in Ohio (sorry) did not mention this prior. He only had liability on the vehicle. She did give insurance infomartion but it was not valid and since she is fighting the DUI and hit skip they have not had their day in court. However, they are not contesting that her car did the damage-she was arrested outside the car and therefore they cannot prove she was driving

Okay, so in December my mother and I were in a bad car accident. A car hit us from behind at about 45-50 mph. We went to the hospital straight away and had x-rays done. They showed that we both had soft tissue damage, and other back problems... Basically both of us are a complete mess. We have been going to the chiropractor for a while now, but it has only helped a little bit. Now, my mother was wondering about the settlement. They said that we are entitled to a settlement, but basically we have to start the negotiating. I think the insurance company is nation wide? But I would have to check. My mother and I were just wondering where we should start when negotiating the settlement. Any help would be very much appreciated, thanks :)

I got into an accident a few days ago. I got hit from the side (on my side, the drivers side) and looking at the car, both driver's side doors (the car is a sedan) are dented in pretty badly, and the bottom of the frame is partially dented in also. In addition, the side airbag inflated and the driver's seat bracket is dented in, with the seat itself displaced as well. Now I know that in order for a car to be "totaled", the repairs to the car would have to be more than how much the car is worth, or is it more than how much is still owed on the car? Well, at any rate, would my car be considered totaled, considering also that the frame is dented in? I know it costs a lot to repair that kind of stuff.. (Btw, I have insurance, so yeah..)

Open Question: Car Accident Question--Who's at fault? (Kinda long but please help)?

In December 2009, let's use car 1 (OURS), car 2, and car 3, and car 4. Car 1 was going down the second farthest right lane for about 10 minutes w/ no switching lanes. As Car1 approached a FWY entrance, Car 2 merges from the entrance right away by skipping the first lane and into the second lane, cutting off Car 1 at the same time at 20mph w/ no signal CAUSING Car 1 to swerve and hit Car 3 in the next lane. This impact caused Car 1 to bounce back and hit Car 2(the Cut-offer) which caused the final impact: Car 1 spun out to face the center divider where Car 4 rammed into its left side. So far, Car 2 is at fault and the scenario depicted up there is what is shown on the police report explaining what happened. Now she wants to fight back. I (being in Car1 as a Passenger) was called yesterday by Car2's insurance not KNOWING it was her insurance because they never specified-- they were just wanting to know 'what happened.' And Im worried right now because I know I shouldnt have admitted to anything since anything can be used against Car1, but I told the story as best I could however, it did not totally match what I just described to you. I told them that I thought we were definitely in the FARTHEST right lane (not 2nd to right) because when the lady cut us off, I opened my eyes and saw her so close and didnt know she came from NOT THE LANE NEXT TO US, but 2 lanes away.So, i was wrong and realized afterwards. Throughout the ride I was kinda just closing my eyes/resting while opening my eyes occasionally to see whats going on.. The lady told me that "an object is pressing charges against Car1 for erratic driving and if there are any objections to that." I told her YES, I object to that because for one, if I were able to easily rest, the driver must have been driving safely and smoothly enough or else I would be petrified the whole time. Secondly, I said that the whole accident happened because Car2 cut Car1 off causing Car1 to "swerve" out and so on. I dont know if my stupid wording has cost Car1 a total turnabout of who's to blame... Car2 was clearly the proximate cause w/ THEIR erratic driving for the entire accident. I already know I shouldnt have said anything but now that I have... I dunno what to do. Ive heard the term "swerve" is AKA erratic driving but Car1 wasnt driving erratically like I explained! From a lawyer's standpoint, do you think they would pick on my individual words or at least take into consideration MY CONTEXT of the story.. because all I was trying to say was Car2 was wrong and caused the accident. Thank you Neil.. and yes unfortunately, it was recorded. I dont know how much of my story will impact whose fault it is... I dont even know if we're going to court so, I cant even know what the insurance people are debating over. I really hope they call again, but I doubt it since it seems like my story is "detailed" enough :( I really think it's the lady who cut us off who is at fault!

I was just contacted by my insurance company (Allstate) letting me know that I will be served with papers very soon regarding a car accident that took place about 4 months ago. I should preface by saying that my insurance company finds me at 5% fault of negligence, and the other party at 95% at fault. The person I spoke with seemed at ease and assures me that everything should be fine. The details of the accident are as follows: I (Cadillac Escalade) was westbound on street A and had the green light and right of way. The other driver (Chevy Malibu) was southbound on street B and ran a red light causing us to meet in the middle of the intersection. There is a police report and it shows the other driver at fault, but the details of the accident are wrong. Also, the officer at the scene asked me if I wanted them to cite a ticket to the other driver, but being the holidays and never been in an accident before I ignorantly told them not to bother. I know.. bad mistake. She was taken to the hospital at her request, and I went home. Anyway, I pursued her insurance company several times and was denied by them each time. Keep in mind, her insurance company is a fly by night shop with little to no credibility. I had my damages repaired and since stopped pursuing their insurance feeling that was a dead end. I was considering suing them as well, but was not looking forward to dealing with lawyers. So, I was ready to just eat my losses and move on with my life. Apparently, her insurance company never pursued Allstate to collect. To me this is a sign that they know she was at fault, or at lease doesn't have a case. Also, I don't have any witnesses. The other driver does have witnesses, but apparently they were all in the car with her (don't think that counts, right?) Anyway, now it appears that she will be suing me. My insurance agent affirmed that they will be providing legal assistance and basically take care of everything. The agent seems very confident that the other driver does not have a case at all. Does this seem right based on the details provided? Is there a chance the other driver can find a loophole and win? I just don't understand why she would sue me despite all the evidence pointing to her being the one at fault. What can I expect going forward? What are my obligations? Do I need my own attorney? Can/should I counter-sue? Does this affect my rates at all? What can I do to better prepare myself for what's to come? I am a bit nervous as this is the first time that I (a) been in an accident, and (b) been sued. All of a sudden they are saying that they had the case reviwewed and they are no longer covering the effects of my head injury, just the wound itself. Open Question: In the eyes of the law, who would be held resposible for this car accident?

I was driving my mums car (my own insurance covers me on other vehicles as 3rd party) and was in the middle lane of the motorway. The woman in the first lane didn't check her blindspot and came into my lane. To avoid her hitting into me, I swerved onto the third lane, lost control of the car (at 70mph), hit the barriers thaty seperate the motorway and bascially, wrote off my mums car. Now, the woman stopped and was clearly upset, admitting fault and apologising profusely. Witnesses also heard her admit fault and one witness left his contact details. The police arrived at the scene and took her into their car for a statement. She was still very upset at this point and although I can't remember clearly, I think she admitted fault in front of the officer with me present. If not, I'm assuming, from the hysterical condition she was in, that she admitted fault to the officer when giving her statement in his car. Now, I receieved a letter from my insurance to say that the highway agency contacted them regarding the cost of repairing the damamge to the barrier. My insurance contacted her insurance and she's now saying it was my fault. Needless to say, I am furious. I keep getting told it would have been better if I had let her hit me - errr...I doubt I would be alive to tell the tale, had I allowed that! Is there a chance I could lose this? Even if she didnt admit it to police yet I have a witness? How about if the police have it on record that she did admit it to them/him?I will take it to court if it will hold...this is very unfair if I lose 5k for the car as well as have to cough up God only know how much, for the barriers! Not to mention my bloomin' insurance premium rocketing! UK law, I should clarify I lost control of the car because I swerved so fast to avoid her hitting me. The speed limit of motorways in the UK is 70 so I wasn't speeding either Ok, for the third time now, I WAS NOT SPEEDING AS THE SPEED LIMIT ON THE MOTORWAY WAS 70MPH AND DID NOT EXCEED THAT LIMIT! So how is that speeding? Could someone please clarify that, in case I'm misunderstanding something here...

Open Question: Are aftermarket parts OK to use instead of OEM parts?

Got in an accident. Other guys insurance is paying for it. The insurance wants me to use aftermarket parts, instead of OEM parts. I have a 2008 Honda Accord. Are aftermarket parts generally on the same level as OEM, or is this something I should object to the insurance company about?

Open Question: Car collision geometry, is there a way to prove the direction the car was travelling from?

I'll explain - I have been involved in minor accident (no one was injured), where the other car has cut in front of me (turning right in front of my car when I was going straight across the road) causing the collision. Now my insurance company came back to me and said that they have to accept liability on my behalf because apparently the other driver is now claiming to have come from my right on the main road, which puts me in the wrong. We have no witnesses and were both alone in our cars. I am wondering is there a way to prove where the other car was travelling from based on the impact damage pattern on our cars? I hit the other car at the passengers side's back door, and my bumper was damaged - I am waiting for a report from the garage that carried out my repairs about which side of the bumper was damaged - as it was not a full front, but only one side (I don't remember which side). I was told by a friend that from the damage to my car it'll be possible to prove that my version of events is the true one. Is there a geometry genius out there who can help me or does anyone know any website with patterns of collisions? thanks a lot! Replying to Josh's post to clarify the matters, as it does look muddled from my descriprion - I was in the driver's seat, it was at a crossroads with no traffic lights, and I was going straight over when nothing was coming on my right, and the other driver was coming from the other side of the road (from where I was going to) at speed with no indicators, as if driving straight across as well, but then turned right, just infront of my car. sorry I was unclear the first time. oh, yes - other important detail - I'm in UK, so driving on the left.

I got into an accident back December and I received a bill from the hospital What can I do? OK to make a long story short a guy rear ended me so of course his insurance will cover me automatically. I received some horrible whiplash and became terribly dizzy so that same night I checked myself in at the hospital. And I'll be damned i got tacked with 4000 dollar damn bill!!!!!!!!!!!!!!!! ARRRRRRRRRRRGGGGGGGGGGG!!! I had a right to get checked out....my body felt awkward. Can I get lawyer or what....does his insurance have to pay right...!!He did it to me::crying:: They ran test on my brain....and yada yada yah!!! Yes I said 4000 dollars btw.....I have no way to pay this S**T off!! I'm a poor college student! LOL HELP ME SERIOUSLY!! what can I do... Someone suggested i don't pay the bill.............but would that screw up my credit up, correct?? is this a good idea>\.... Then I would be doomed forever and ever AMAN!!!!!!!!!!

I am currently 16 years old and drive a 2001 Camry. My parents promised me a fairly good car once i graduate high school. Right now i have my hopes on a Chevrolet Camaro. Either a 2009 or 2010. A V6 engine. Most like the lowest costing package for it. I have no tickets or accidents right now and lets say i wont get any in the near future. He cannot remember the exact number but he knows that when he arranged them in groups of 2, there was one left. When he arranged them is groups of 3 there was one left. When he arranged them in groups of 4 or 5 or 6, there was also one left. But when he arranged them in groups of 7, there were none left out. HOW MANY EGGS WERE IN THE CAR? gosh almighty, its not my frickin homework!!!!!!! its from a book called brain phart!!!!!! i figured out it has to end in a one or a six wait no, it has to end in a one OK NEVERMIND ITS 301!!!!!!!

is it a good idea for my attorney to renegotiate my medical bills to pay less due to the insurance of the lady that hit me and my insurance does not even cover half of all my medical bills (the accident I had was not my fault at all but I have on my insurance something of UMI or something) or just pay some of the bills with what I get and then sue the lady that hit me so she can pay for the rest of the bills or do both or how does this all work it is my first accident so I don't really know how it works and if its a good idea to renegotiate all my bills what would happen with the lady does she have to pay for the original amount or ????? thank you for answering but please answer if you know this is serious for me thank you I already have an attorney and againg with the lady insurance and mines my medical bills dont get payed not even half of them with mines and hers its 50K minus 33% of my attorney and my medical bills are 95K only adding these details because the first one that answer did not understood.

If someone who thinks they're invincible and thus doesn't buy health insurance (who otherwise could easily afford it) and ends up in a hospital after a car accident or gets diagnosed with something major, and thus can't pay their bill, why should all our health insurance premiums go up bc of someone else's stupidity? Now if one can pay out of pocket for all expenses like Rush Limbaugh - that's a different story, but very very very few of us can do that. It seems like some of the conservatives aren't getting it, so I shall explain it further. For people who are uninsured and can not pay their hospital bill, their costs get transferred to the rest of the private insurance industry and then TO THE REST OF US, in higher premiums, whether you like it or not. Malignant Narcissist, that's the point, using your example, if a heroin user who is uninsured, is not responsible at the end for his/her costs. The REST of us are in the end (by paying higher premiums for the bill the uninsured heroin addict couldn't pay). kpk02, you moron, obviously in the beginning they get the bill (until they claim bankruptcy or they just plainly say they can't pay), but once they are not able to pay and since hospitals want their money now, it's paid by the rest of us. You've shown you know ABSOLUTELY nothing about how healthcare bills are paid. Islam Delenda, you can get the lowest price insurance plan from a private company which only covers catastrophic care, even currently. No one has mandated a cadillac plan. Is this fair? My husband and i met 7 years ago, at that time he said he had been divorced 3 years. Husband proposed to me several times after we had been dating for about 10 months-then he sprang on me he was not really divorced, but said he had filed 3 months after we met-and said his divorce would be final in august 2004-he maintained his divorce was final in 2004 until last december. Husband and I married in may 2006-at that time we lived 40 min away from his ex and their daughter-he went alone to see them almost every weekend-i was never allowed to go, nor hav i ever talked to them on phone-i'v had 0 contact w/them from day one. At that time husband said his ex had amnesia from car accident, was crazy form head injury and thought they were still married. Last december some issues w/insurance company required him to produce copy of his final divorce decree-and he didn't have one-he then clamed ex failed to pay filing fee and that was why their divorce was never even filed. Then he said his daughter had been upset about divorce-so he commited bigamy so he could marry me and keep daughter happy. Is this a messed up situation or what? Is husband justified in lying about being divorced and commiting bigamy because he has a child? I feel he should have been honest in the first place.

I had an accident with a tractor trailer 2 weeks ago and just contacted with his insurance company, he hit me but is was documented in the police report that both were at fault. i have liability on the car, and was rushed to the hospital! do you think his insurance will pay for my 2001 saturn car? help? should I threaten his insurance company that I will sue him to get the money for the car and towing costs?

My daughter injured her elbow back in August 2009 from the slide at the preschool she's in. Can I bill my deductible and copay to the preschool? What is the law for preschool injuries. Can they avoid any liability just by saying - accidents do happen? Update on this questions per March 2010: The only answer I got on this question was: Yes, accident DO happen and move on with your life. While contemplating on what to do, I went ahead and asked anyway. I asked the possibility of getting reimbursed of any medical bills occurred. Of course I asked very nicely and non-forcefully. One of the Qs I had for the school was: "Is this school covered by any insurance?" The answer was: "Yes we are, and go a head fill out this form and our insurance will take care of it" So the school paid for a +/- $500 bill without any problem. There were no hard feelings; my child currently is still going to the same school. So, my two cents: Don't be afraid to ask anyway!

I got into an accident, and it was definetly not my fauly. i was just driving straight and the other car was coming from the opposite direction, they were taking a left, the girl basically turned right into me, i had the right away. anyways, geico said they took 90% of the liability, so they will only cover 90% of a rental car while my car is being fixed, i am so pissed off about this, it's not right! i don't care if im only responsible for 10% of the rental car, i should not have to pay a dime! they don't seem to want to hear me out when i call, so i found this website... http://www.ins.state.ny.us/ Should i file a complaint? they offered to pay 90% of the rental which is pretty good, i dont want to screw that up, but it's not right that they won't take 100% reliability. nobody really seems to care when i call over there.

Or All-State, or Progressive for that matter? My insurance rates are ridiculous because of my age and since I've had an accident, so I've been shopping around. I've learned that through Met Life and Auto I get a 20% discount from my employer, but even with that my monthly payment for $1,000 deductible is $365.00 (yes I said monthly, $415.00 for the smaller deductible). All-State and Progressive quoted me similar prices. So I called a couple of places that I've never heard of before, that offer the EXACT same benefits, and one of them quoted me for $200.00 a month. So I am saving over $160.00 for using a company that isn't a big name, and there's no coverage differences. I guess I just don't understand why more people don't use the "non big name" insurance companies if they can save you this much money.

I was in somebody else's car last November and they wrecked, breaking my tibia in 3 places. I'm done with surgeries/procedures at this point and I'm close to starting the settlement process. Does anybody have ANY idea how much I could potentially receive for this? (*I also hurt my right hip, my back, and my neck was tweeked in the accident.*)
