Resolved Question: Is working, while applying for disability and SS fraud if he put he was unemployed?

So my friend applied for disability and SS because he lost his job and scholarship for school because he had a heart attack at 21. So we was hospitalized a couple times while waiting because of his heart condition. He doesn't have health insurance and this was the main reason why he applied for SS. So he decided to get an under the table job at a commission based telemarketing office because his bills were adding up. 4 months later he hears that he is eligible for SS but denied disability. He also realizes that his boss filed a tax form on him based on the money he was making. So when he applied for disability he was unemployed but because SS was taking so long and the bills were adding up, he felt he had to get some sort of job to pay them. So would it be considered fraud since when he applied he said he was unemployed but currently employed now? He hasn't received any money from SS yet but will he still be in trouble for being employed while waiting? Is there a way that he can still receive SS benefits if he quits his job?

I applied for SSI in 2006 shortly after I was given an extension on my unemployment insurance, I asked the girl if I could collect if I already applied for SSI. She aked if I was receiving a disability check and I told her no that they turned me down and I appealed it. She told me that it was ok to receive unemployment until the Social Security dept reconized my disability because until they did I am not really considered disabled. Well they finally after two and a half years awarded me the SSI but the back pay overlaps the unemployment by two months. Now I am concerned because I don't want to be charged with fraud for collecting both. I haven't collected unemployment for about six months now. At the time I did however I was working four hours a week so technically when I said I could work I was working. Now they want information as to what money I have had coming in since the SSI awarded date. David M if you are out there please respond

I have been on Social Security for many years and have on occasion received certification letters in the mail. I am now being sent the same paperwork, should there be concern for this? I am afraid of losing my benefits as my husband is currently unemployed and we are barely making it on my small disability benefits. Thanks for your help.

Complicated Work Comp Case Basic Overview: A friend of mine has found himself in a horrible situation after 1 year of Work Comp case proceedings. The following facts are pertinent to his specific situation: IN BRIEF Employment History: 1. Employed with employer 20+ years 2. Almost no Disciplinary or problems with employer until Company recently merged with another company and has since become "Self Insured". 3. Company began making constant demands for employee to sign "At Will" and "Acknowledgment" there of documents. 4. Employee got first write up in 20 years and asked to sign "at will" at the time of write up. Upon refusal to do so due to the contract stating that he was to carefully consider what he was signing, he was forced to a new machine for "training purposes" that of which he initially believed a prior injury may had been exacerbated due to repetitive motion of his wrist. Industrial Injury History: 1. Old injury to wrist 10 years before; new injury appears to be separate injury but may be contributing to aggravation of the newly diagnosed mild carpal tunnel syndrome in both wrists. 2. Both past and present Injuries were sustained while with same employer New Injury: 1. Employee informed supervisor of swollen wrist while on new machine, he gave him wrapping gauze and sent him back to work. 2. 2 weeks later Employee went to emergency after a failed attempt to talk to the General Manager for swollen wrist and stress due to industrial injury as a result of being denied treatment. 3.Employer started immediate "fraud investigation". 4. Employer informed employee of UPN doctor he had to go to; employee complied not knowing rights at the time. 5. Employee sent to drug test; Doctor suitable to treat injuries was not in on the date of referral, also employer did not list the "wrist" injury, only listed "stress" on referral slip. 6. Employee returned to employer for correct referral slip and returned to UPN doctor who did no referral for psychiatric treatment and sent employee to get old medical records in part with return to work slip. 7. Employer had employee fill out wc form 1 almost a month after injury; he complied 8. Employer informed employee of need to separate claims; and verbal statement of denial saying "stress" is self inflicted due to detachment from machine. 9. Employee placed on Short Term Disability; pressured by employer to fill out FMLA forms and refused as it is industrial injury not FMLA related. 10. Employee obtained an Attorney 11. Employee complied with all doctor referrals from attorney 12. Employee wanted to get surgery and go back to work. ATTORNEY DISASTER/PRIORITY CONFERENCE 1. Employee sent formal request to attorney inclusive of questions as to why no expedite hearing had been requested in part with need for surgery, why he had been sent to a QME instead of a AME as informed in a letter, and why his deposition is scheduled after Priority Conference Date. 2. Attorney Request to Withdraw immediately 3. Attorney wont give original file 4. Attorney sent copy of file of 400+ papers mixed up that 5. Employee can't access WC WCAB file even after getting authorization from Sacramento; they claim 14 days for file to documents to be sent. 6. Copies of WC form sent in file copy from attorney state new claim for injury was submitted due to "harassment" without employees knowledge. No trace of original claim form (he does have a copy of the first one he actually filled out) 7. Attorney is still on record despite his claim to be relieved due to his request to Withdraw. 8. Employee just found out no medical records were entered on his behalf and priority conference is next week **Employee can't seem to be able to confirm insurance carrier of Employer. a person recieves a settlement from a former employer for long term disabilities, then that person goes on to work under the table as fishing guide for 15 years and works as a honouray director for a non profit organisation for 10 years. Would this mean the person was able to continue working with previous employer, regardless of handicap?

Who stores medical histories for insurance companies? Who can access such info? Can my doctor; can I in all cases? Say an insurance company, such as Prudential, knows more about my risks than I did ~ when I purchased life insurance ~. Does a company, like like a large insurance company, keep this info if one kept even part of the money from that insurance policy in their hands, after a corporate reshuffling that left one without life insurance? Or does such an insurance company hide behind neoconservative legal opinion that states a company can virtually do whatever it wants to? I know they keep all the records they can, so-as to be able to debate the merits of a claim in court and keep fraud down. The question is, who, what, when, where and why not give access? Seriously, my ex is a psyche nurse. A very large sum of money went missing. I perhaps cannot prove I even had said cash without access to medical records. The psyche hospital she worked at has repeatedly "helped her case". And I'm perhaps facing deadbeat dad law federal jail time after several incidences of attempted murder in jail for both civil law (deadbeat dad) and procedural law "violations" (I'm a squealer, yup, couldn't be quiet after the truth serum / head-wounds). If insurance companies can help prove employment (never worked for the law without being hurt BAD) then why do I have this problem? Can't someone help? Why do people naturally assume if "law" is the problem, law is the answer? Cause to me, going whole hog on the eggs in a basket thing seems A TAD silly. If lawyers want to be judges (AND MANY DO) or lawyers want to win cases (AND ALL MIGHT VERY WELL, ASIDE OF COURSE FROM PUBLIC DEFENDERS), then they might want to pander to the political mindlessness that put them in office (THE JUDGES BENCHES ARE FOR SALE ~ FOR JUDGEMENTS BASED ON POLITICAL RHETORIC RATHER THAN LAW, OBVIOUSLY ~ CAUSE YOU CAN'T GET TO DEADBEAT DAD UNLESS ONE FORGETS WE HAVE A CONSTITUTION, WHICH THE COURTS HAVE DONE). So the question is: given I've an old medical history / job history that is poorly doccumented, how do I get around the silly court notion that I must prove my case or face real and substancial jail time at hard labor if I can't "prove" I'm a cripple, to a "family court" wherein no lawyer will be on my side (not even a laughable public defender) and the court's presumption is "guilt by lazyness" ? In family court, the standard is "civil law". This means whatever is assumed to be better than 50% "likely" is cause for a "finding" that that "more likely" thing is the fact of the matter. For instance, many political judiciaries who call themselves Constitutionalists consider it 50% more likely a liberal works only 50% as hard as he might, and impute incomes accordingly.

We keep getting bills from where my hubbys ex wife is taking the kids to the ER! We have no clue they have even ben till we get the bill! Hubby has ben on disability for 7yrs an the divorce papers say that his ex is responsible for keeping the insurance an half of the medical bills an we pay the other half! We keep getting these bills for the full amount though. The ex is signing his name an when we contacted the place sending the bill they told us that we would have to file fraud charges for her signing his name! If we do file the fraud charges what will they do to her?? How serious are these kind of charges?an how can we find out if she is signing his name to anything else??

- If the motorcycle was my only means of transportation, would it be wrong to ride it if it does not cause me any additional pain? -How do the insurance people look at this issue? Would I be doing something wrong? -I am not a fraud, and have a legitimate back issue documented by doctors, and the pain changes each day. -Is it ok to ride on days where the pain is minor due to the fact that the motorcycle is a means of transportation? -Serious answers only would be appreciated. I am on my daughter's account. I have a cruiser motorcycle, and I am a 49 yr old male. Cindy, that was not the answer I was looking for. I appreciate all your answers and I guess if this is something I will feel guilty about or asking about, I should not be doing it.

Voting Question: I have a friend that an addict,abusing his medical assistance, will he get caught?

My boy, which ive known now for close to 15 years just got out of rehab for the 7th time. He stayed clean for a few days shy of 3 months. In that time, he received medical assistance and trying to get disability just so he has an excuse to stay high, not work, and eventually die or end up in jail for a long time. The problem is that he has a family doctor, which doesn't know he is an addict and he talked her into giving him pain medicine, sleeping pills, and who knows what else. I just found out from his mom the other day that he is also going to a few free medical clinics in carroll county MD. I guess they just ask you if you have insurance and you say yes, and they take your word on it. They are also giving him narcotics. I know he will hate me but shouldn't I call his doctor and find out what clinics he is conning and tell them. The thing is, if they check after i call and see he has insurance when you cant be seen there unless you are unemployed, and obviously don't have insurance. I am scared he will get locked up for insurance fraud or doctor shopping. But, I don't want to get a call from his mom saying he just died. Please give me some advice

Filipino couple in US to get 215 years for hiring illegal aliens CHICAGO – A Filipino couple, who owned a health care agency, face sentencing of up to 215 years in prison for bringing in to the United States illegal aliens, mostly from the Philippines. Wilfredo Tiongco Ngo, 51, and his wife, Maria Teresa Lamayo Ngo, 49, co-owners of A-Plus Planning Services in Orange County in California, also face a stiff fine of $10.75 million or “twice the gross gain or gross loss resulting from the offenses, which ever is greatest." Sentencing has been scheduled for September 21 by Judge David O. Carter of the US District Court of Central District of California in Los Angeles. The couple were charged in August last year with a four-count indictment, including: 1. Inducing aliens to reside in the United States; 2. Knowingly employing illegal aliens; 3. Knowingly harboring illegal aliens; and 4. Counseling persons to engage in marriage fraud. When they were arraigned by US Magistrate Judge Marc L. Goldman last August 25, 2008, the Ngo's and their co-accused, Gicela Sarabia, 43, pleaded not guilty of the charges against them. Last month, however, the couple pleaded guilty of Count No. 1 as part of a plea bargain. Sarabia, who was charged with inducing aliens to reside in the US and knowingly hiring illegal aliens, has not yet copped a plea. It was not known if the Philippine Consulate in Los Angeles was advised by US immigration authorities of the arrest of the Ngos and the couple's right to seek help from the Philippine Consulate as mandated by the 1963 Vienna Convention on Consular Relations of which both the Philippines and the United States are signatories. The Ngos are Philippine citizens. A-Plus Senior Planning Services is a private health care agency that provides basic care to the elderly in assisted-living facilities in Orange County since January 2005. It has 200 employees, half of them undocumented. It has 65 employees, 20 with non-immigrant visas, with denied political asylum, engaged in fraudulent sham marriage or had been previously ordered deported. The agency was originally named Better Care Solutions. When the company was audited, it changed its name to A-Plus Senior Planning Services. The agreement was agreed and accepted by Mieke I. Biesheuvel, assistant US attorney on behalf of Thomas P. O’Brien, US attorney for the Central District of California, and Robert A. Van Hoy, counsel for defendant Maria Teresa Lamayo Ngo, and Mark W. Fredrick, counsel for Wilfredo Tiongco Ngo. The alleged illegal activity of A-Plus was found out when two Filipino caregivers filed unemployment claims in July and October of 2006 with the California Employment Development Division. Better Care Solutions was later discovered not paying unemployment insurance from 2004 to 2007, employment-training taxes, disability insurance and personal income (state) tax, which resulted in two separate tax liens totaling $124,000. Eight years ago I caught my ex with my best friend at my parents home while they were out of town. I divorced him. He was in the middle of a workers comp claim that I know was a fraud. He was granted 100% disability. He has since splurged enough money on my 17yr old to take her completely away from me. And now working on my 8yr old. I do not have the money to keep going back to court. This man that is "disabled" runs the local AYSO soccer, keeps the grounds, works side jobs, smokes pot (I have proof), four wheeler rider, hunts, travels, coaches softball, and the other day did 21 push ups for the ball team, with "fracture c2vertebra, black out spells and short term memory loss. His house supposedly robbed last summer to which her received a large settlement and then found everything but did not report it to the police or insurance. He is now taking me back to court for the ? time and wants the 8yr old because he wants her SSI check. I do not have the money to do this and he is now has a myspace for the eight yr old that is a direct order from the judge not to have. He also dropped her off at to spend the night at several peoples home and these people come up to us at restaraunts and tell us how good she was when she stayed at thier home that I do not even no or no that she was there. The latest is Easter night. He called to tell me that he had taken her to a bday party and that I would have to pick her up there the next morning. He had no phone number(it had been cut off) and did not even know these people. I told him if he did not want her for Easter then bring her to me. He told me to go get her myself because he does not tell his children no, that I would have to be the bad guy. What do I do? I have been married twice and my second husband could not handle it and he was a divorce lawyer?? Now my third husband is showing signs of the same nature. Help!

I am afraid I may get charged with insurance fraud and be denied the disability that I already tried to file for. Please help.

A close relative of mine went on short-term disability leave back in September right before having early-stage breast cancer surgery and has been receiving short-term disability payments from her employer's insurance company ever since. Following surgery and subsequent radiation (she didn't need chemo), more and more "stuff" started appearing at her house that she'd been buying with the insurance money--new clothes, a new sofa, she's talking about getting a treadmill, etc.--and spending hours online looking up genealogy-related stuff, which is a big hobby of hers. She's also taken a number of trips to see relatives around the state and has gone with them on hobby-oriented excursions for several days at a time (some of the relatives are self-employed while others are retired) and apparently having a grand old time. Meanwhile she's had no medical treatments in nearly two months--she finished radiation in January--but she says she still doesn't feel well enough to go back to work, and oh yeah, she also mentioned out loud on at least one occasion that she's making more money from short-term disability than she does from her job. But she feels really lousy and can't go back to work because she's not ready, yadda yadda yadda, but you wouldn't know it from the way she's been acting and the way she's been spending money on things she doesn't need to live. I'm waiting to hear back from her insurance company on an anonymous call I placed to their fraud hotline, but it got me to wondering...I and many other relatives are seeing her do all of these things, but she's apparently still giving her doctor this line that she's not ready to go back to work, etc., and besides the fact that she's stealing from the system, it's really creating major tensions within the family. So what I'm asking is, once I give the insurance company the details of what I know and what I've observed, how can it be proven that she's milking the system and what can be done to stop her? In the back of my mind I'm thinking it could even get her arrested if this sort of fraud is deemed serious enough, but not having dealt with anything like this before, I'm not sure how this plays out. My best friend's mom is claiming my friend on her insurance as disabled. My friend works a full time job 40 hours a week, and she has her own insurance. When she confronts her mom about the insurance they have her on, her mom won't take her off. Is this insurance fraud? What can be done if her mom continues to keep her on the insurance as disabled? She kicked him in the ribs and broke them once before, and she has the whole house filthy because she is a pack rat, she steals does insurance fraud , she injures their children and then files claims on them and tries to take all the disability money, if the kids want to have friends over she calls the police right away so that they are alone and isolated in their rooms and she puts locks on everything the fridge so they can't eat, and cameras everywhere and says she will have the police come asap if they misbehave, even if it's just something imaginary like 'disrespecting her' and she calls the police about five times a day, she took all of their cars away so they can't go to school and she also tried to go on 'dinner dates' with them when she is bored because she has no friends. And she doesn't bathe and threatens people constantly etc....My dad wants a divorce but he is afraid she will stalk him or take all of his money. Can he legally be allowed to leave her without giving her a dime ? She also just married him as a meal ticket.

Really ? Why has no fine patriotic democrat asked these questions ? Is it patriotic for lazy , dishonest , able people to defraud the disability insurance program ? Is it patriotic for the same people to defraud the food stamp program ? Is it patriotic for politicians to stuff their pockets at taxpayer expense ( see Alabama 2 year college scandal ) ? Is it patriotic to keep demanding more and more of hard working Americans income when there is rampant fraud , waste and mismanagement in Washington with little to no accountability ? Only few , if any of our elected representatives and even less among those appointed could be considered truly patriotic . Biden wouldn't even be considered in that group . With all of the fraud even among our leaders he has some kind of nerve to state that I am not patriotic because I refuse to voluntarily support the millions of lazy , dishonest people and politicians who refuse to work an honest days work .

I live in Pittsburgh, PA and I know of someone who is collecting disability from the city, and they are not disabled. Our taxes pay for people like this. She supossedly hurt her knee, but she sure ran after the neighbor and me.

Resolved Question: can my son sue me for credit card fraud even though he gave me permission to use them and I made the payments

My son andI talked and agreed that it would be a good idea for him to accept a couple of the pre approved credit card offers he had received in the mail to start building him some credit. The deal was I would keep the cards use them for things we needed and I would make the payments since I had much more money coming in at the time. Everything was going great I was even able to pay off the entire monthly balance sometimes but always payed almost half of the balance. I quickly built his credit score up to almost 700 in one year. Well my luck took a turn for the worse I lost 1,600 of my monthly income within 6 months since over half my income was coming SS survivors benifits from when thier Father passed away. I still had one check coming in plus my income from my job which was not much. I now had to start making the minimum payments on the cards after maxing them out due to lost income and no health insurance. I spoke with my son and we agreed it would be best to take a low interest loan from our bank to pay the cards off because just making the minimum payment the balance would never come down so he did and the cards were paid off. I still had the cards in my possesion which was suppose to have been cut up unfortunately I did not do that right away. Well more bad luck came my way I developed some very serious health problems which interfered with my work and I started missing work which led to eventually not being able to work at all and now I am in the process of appealing a disability claim. I started to use the cards again for things we needed to get by and this was without the permission of my son because I assumed I could keep up the minimum payments. Well all it took was one missed payment on the cards and things just spiraled out of control with all the charges which resulted in me not being able to make the payments at all. I was keeping this to myself desperately trying to find a way to work this out. I eventualy found out that credit card companys will not negotiate until the account is 90 days past due which I am in the process of doing now. My son just recently found out about it and went through the roof which he had every right to I assured him I am doing everything in my power to negotiate a settlement payment. I made an offer in writing to the companys which we are still waiting to hear from. One thing about my son he has a very bad temper and can get violent he is 20 yrs old and he got the cards over two years ago. He starts arguments about the matter and sometimes threatens to sue me for credit card fraud...can he?. when ever I used the cards I always signed my name never his, I am in no way justifying my actions but can he sue me for fraud?.

I am a client with a certain company and I am paying back a loan, not a mortgage, but I had the disability insurance, and they paid 10,000 of a 14,000 loan, now they are telling me I owe 12,000. I asked how they figure, and they couldn't tell me. I told them i was basically paying double. Can I have then audited!? Please help!

How would I go about reporting someone who is being paid off the books in New York State? There is a person I work with who is being paid off the books. This person is a relative of the owner and I know for a fact she is recieving benefits from the state(food stamps, health insurance, disability). She braggs to people that she is tricking the county. Iam sick of my tax dollars going to support her while she is illegally working and recieving benefits. I want to remain annoymous. Is there a way to submit her info online without having to call the irs or county? I have see the forms where you print them and sent them in by mail and the phone number. Iam looking for a way to submit the information online

(this person has not worked for over 5 years and only recently filed for SSDI) Does the SSDI check have to pay for that persons living expenses???? This person lives with their wealthy mother who pays all the bills. He has been on methadone maintenance for over 20 years and abuses alcohol daily. As far as being disabled, He is NOT. He just doesn't want to work. He has a voracious appetite and is 100lbs overweight. He is laughing at the system, has a Dr who is willing to fill out papers to show how "sick" he is , and plans to use his check for drugs and entertainment. Bottom line. Should I report this person for fraud???????

Voting Question: Has anyone else out there experienced the FRAUD with medicare drug coverage insurance?

There was a recent article in the Fort Worth/Dallas Tel Star paper regarding this, and another article showing that Humana, one of the Medicare drug companies, is now being audited for fraudulent practices. I am on disability, and have been fighting my own battle over this for 6 months...the issue is, the computer system at the Centers for Medicare and Medicaid Services has a "glitch", which is preventing the premiums for those on disability from being transferred from the US Treasury to the drug companies and the drug companies are trying to bill the customers for the GOVERNMENT'S COMPUTER PROBLEM....the customers don't owe the money....it was already taken out of their disability checks by Social Security, and placed "somewhere in the US Treasury"....but the drug companies are refusing to clear the balances of the individuals on disability, until they "get their money".....which is in the US TREASURY.....I have already gotten my congressman involved for me in trying to clear my acct

A friend of mine cashed a check from his insurance company that was supposed to be used to pay the anesthesiology bill for surgery. The check was made out to him and him alone. His disability insurance was running out and he needed to pay his bills. He called up the anesthesiology people to make payment arrangements and they sent him to a bill collector. The bill collector contacted him and told him that he committed insurance fraud and that if he doesn't pay the whole bill in one month he is going to jail. Are they just trying to scare him or is that the truth?

I am in a situation and I really need help. I tend to attract people thtat need advice. My neighbor came to me and said that her best friend, someone that she has been friends with for a very long time called yesterday and very proudly admitted that she was selling her daughters ADHD meds to some college students for 5$ a pill. This woman is always struggling for money and feels like her prayers have been answered. my neighbor asked her how she is getting extra ADHD meds when insursnce companys are so strict. This lady Debbie said Oh my daughter (12 years old) doesn't need to take them every day (not what the doctor says). Debbie also feels that her daughter is old enough to contribute (like the socal secruity that her mother gets for her is not enough). Apparently, Debbie's house is filthy and her kids are pretty oiut of control. I told my friend that for the sake of those kids even if all of the insurance and disability fraud dosn't do it for you she needs to turn her in. WW you do?

My brother is on disability income and has about $600 a month to live on. He really needs to have a car because he lives in a rural area and there is no public transportation whatsoever.He doesn't have much money for gas, but the insurance is really the killer, it's about $150 a month at state farm (and he insures his home with that company also). does anyone know any good options for him to save money? Is it legal if he just ditches the car and the insurance and drives one of my cars some of the time, or is that fraud? He does not drive to work or school, only to get groceries/prescriptions etc. The county workers just roll their eyes and sigh and say transportation is a problem.And they don't help. Can I add him to my policy? He's in the same zip code, about 8 miles away. He already doesn't have collision or comprehensive, it's an old car.And he has great credit and no accidents/moving violations. Thanks for any help you can give!

I'm trying to set up disability insurance, but it's been almost a month, and it's still not in place yet. It's illegal for me to work while attempting to set up disability insurance, as that would constitute insurance fraud, and I hurt to bad to work anyway. Is there anywhere I can go for help, that will compansate me in addition to the disability insurance I'm trying to get in place. I expect to be out of work for at least another few weeks. I have no money, and bills are beginning to fall due.

I know a woman (she is not a friend) who is claiming disability and has her rent paid by the local council. She has her partner living with her (fact) and he is not on the tenancy (this is also a fact). I am "paying her rent" as she does not work, so would not be paying income tax or national insurance, and they have his full time income for them to socialise on. I see them most nights dressed to go out going down to her new car.

i am out on comp herniated disc comp is paying have been paying for long and short term disability thru work for 3 yrs our company was bought out in march and payments were still deducted from our checks weekly since they bought us out in march i called the insurance company and our policy was cancelled last april 1st for non payment and because it was a group policy the individual policy holders were not notified but new company still deducted payments from our checks we thought we were covered no that i may need to use the disability i find out we are not coveredwhat can i do im afraid to cause a stink as i need my job when i get better
