Open Question: Any one with knowledge on the Family Medical Leave of absence?

I have been out of work due to an injury for 3 wks, dr says 3 more wks, I figured I was out on short term disability or a medical leave of absence. Therefore my employer must maintain my medical insurance, I read it in the law, but my question is am I automaticly on FMLA or is there something I have to do to get it? The reason Iam asking is my employer knows I want to be on it, but on my short term disability claim form he wrote in (not requested). Now like I said he knows that I THINK Im already on it, because he was trying to say I only qualify for 1 more week of FMLA Because I have already been out 3 wks and in January and Febuary last year I was out for surgery. He seems to think he is responsible for 12 weeks in a 14 mth peroid not true it is 12 weeks in a 12 month period. So I know I qualify, my question is how do I get it or is it automatic? Open Question: Will Government-Run Health Insurance Pay Claims as Well as Our Personal Health Insurance?

My child has a permanent disability and is covered under a personal health insurance plan that I purchased before she was born. It provides excellent coverage and cannot be canceled unless I fail to pay the premiums or the company pulls completely out of my state. It has paid claims beautifully and even bought her a Wii Fit because her physical therapist letter of recommendation confirmed that the kids will use the Wii Fit much better than they will climb the "stairs to nowhere", or any other conventional form of PT. I can confirm my child prefers the Wii Fit "a thousand times more than the old therapies". Also, her multiple surgeries have been completely paid without a hitch and her orthopedic surgeon said he really likes my company's reimbursement policies. He commented that the Medicaid patients pay him very slowly and at a much lower rate and requires far, far more documentation. In the event ObamaCare becomes the law of the land, how can supporters assure me that they will not affect private insurance companies ability to survive in under the Senate plan that may be passed under simple majority or "deem as passed"? Would the government run health care we will receive 4 or 5 years after the taxes begin likely pay her claims as well as our current personal health insurance plan? Carole, I have read highlights of the Senate plan that Nancy Pelosi wants to pass under "deem as passed" without the Constitutionally required vote of both Houses and found it infinitely more complicated and difficult to understand than my 24 page private insurance policy. Nina, I have read the one paragraph in my policy that outlines the three reasons they are able to drop her. Again, the only way they will drop her is if I fail to pay the premiums, she exceeds the $5 million lifetime benefit, or if UHC completely withdraws from my state. They will not summarily drop her for any other reason. We have confirmed this with a lawyer.

My father, 51, had been an hourly worker in a machine shop of for 21 years and four months. On a Christmas holiday, he suffered a severe heart attack and was hospitalized for three weeks. At his release, his doctor said he was to rest at home for a couple of months. After his recuperation period, his doctor, along with his company’s physicians, was to decide whether or not my father should retired for disability reasons. They never got the opportunity to make this decision; in February, my father died of a second heart attack. He left my mother, four sons, two daughters and two-daughters in-law. His wife, my mother, still had four children at home. As part of my father's estate, my mother received the normal group insurance payments, the balance of his savings plan account, and the other benefits due her. However, my mother did not receive a pension from the company as a survivor of an eligible employee. When my mother and the company representatives had discussed the settlement, my mother had inquired about my father's pension and about my mother's right to receive it. The human resource department had stated that since contributions to this fund were made only by the company, no survivor’s benefits were provided. 1.What do you think my mother should do at this point? 2.What does the Employment Retirement Income Security Act of 1974 have to say about this issue?

no they are real grants that can get money6 to help disability people as I need 1500 to get straighten out fix my vehichle get cought up on bills light bill phone bill insurance and got good credit but am at point that they cannot loan me any money due to me have to have a certain p-ercentage left before they can loan you the money please4 somebody help me I even can pay the 125 month till the 1500 is payed and the interest to but the laws will not mlet them loan over so much percentage of your check i draw 708 month my vehichle has tore up and it cost 1200 to fix it and in real trouble if donr figure out what to do ,fast I lose everthoing without be able fix it and lose all my credit if cant get fixed and then lose my ability to get a loan no family to help nobody turn to thought hope so bad some body no what i doi to get it cant make it over weekkk longer before loss the vehichle and then lose my credit ability to borrow money and only ndraw 708 month and if lose that have no way to0 even pay any bills my rent gas bill light bill grocried noway to get to dr no mway to do nothoing so pleaese mean more than words could say i ned some help so bad.

I asked this earlier, and really got no good advice. So I will make the story shorter. Long story short, my MIL is getting married in less than a month to a guy she just met in November. My husband has met him, guy is a jerk, won't work, and just dumped my mother in law during the entire month of December to be with his 2nd ex-wife. My MIL is completely desperate to have a man in her life, and almost did this 2 years ago (with another guy). Luckily, the guy left her for another woman and it didn't happen. It seems these men use her to make their ex-wives jealous, and she can't see that. How can my husband talk to her about it? He doens't want to tell her what to do, and isn't judging her...there is just alot of stuff she won't ask men that is important to a marriage. She says things like what kind of debt, if any, the guy has, life insurance, where they will live, what his kids are like (he has 6 grown children and 14 great-grandchildren) are none of her business...?? We've been asking her questions that you typically ask someone close to you getting married, and she has no idea. All she knows is that he's been married 2x, that he's on disability, and goes to the same church as her. This has barely a 25% chance of this working, and she already is pressed for money. I'd just hate to see her marry this guy out of desperation, get used, and then have to pay money for a divorce and whatever else my happen during the marriage. My sister in law has already tried to talk to her, but she says that her kids just don't want her to be happy and that she deserves this. She's hasn't been a bad mother to my husband and sis-in-law, but she certainly hasn't been the greatest. Ever since she divorced their dad, she will "abandon" them as in not returning their calls, never coming to visit, going on long trips with the guys, etc. and ignoring her kids. Their dad died last year, and I think that they are hurt by their only real family. Should we just not say anything, perhaps let her marry the guy and learn her lesson the hard way, or should he sit down and say hey, I really think you should get to know this guy better...what's the rush? I'd really like some advice from someone who has perhaps experienced this. And, before you say it's none of my business, it is when it comes to holidays and family events, and my husband and his sister are devastated because his mom won't come around when she's with a guy. And, to be quite honest, he has a career and I'm in a professional school, and I'm not inviting random guys to holidays at my (most likely very nice) house someday to avoid making her mad. I mean, this is the kind of stuff that makes shows like forensic files, etc. Garnet, your answer really isn't answering the question as to how we should VOICE our opinion. She allowed my husbands father to beat both children, broke bones and all for their entire lives, because she is selfish and didn't want to "not have a man". When he started bringing other women to their house...then she had no other choice. Anyway, she is all they have, and after their crappy life of being put thru being around one horrible man, she continues to do so and it hurts them...because like I said...she is their mother and although she has given them a crappy life, she is the only family they have. And no, I never ignored my parents advice. I heeded it. Obviously you are a bitter old lady just like my MIL. We are trying to help and trying to find the best way to go about it....that's all. NOT tell her what to do.

My daughter in law works for a company that is being sold out to another company. She is 8 months pregnant and just found out this is to take place next week. She has been paying extra for several years for a short term disability coverage that would cover maternity leave. The company is planning on laying all the employees off, then the new company is going to offer to rehire with a pay cut. The new company is keeping the same insurance, but will this effect her maternity pay? Should she go ahead and go on her maternity leave early to claim her benefits?

If you work for a company and have paid for short term disability insurance for several years and have found out that your company is getting ready to change owners , They plan to lay off all the employees and then offer to rehire. Will the insurance still be in effect? This is my daughter in law, she is 8 months pregnant and has worked for this company for 10 years. What will be her best choice to do, she is thinking about getting the doctor to put her out of work now and start drawing her disability, What should she do?

My brother's wife was diagnosed with ADHD as a child and still shows just about every symptom of it but doesn't take medicine for it because she thinks she's just fine. She yells at her youngest child on a daily, almost hourly basis when she's at home. Both children are autistic just fyi. And every time she gets mad, she threatens to take the kids, leave and never know where they are if my brother doesn't do what she says. *even though we've told my brother over and over that if she done that, it would be kidnapping so she couldn't really threaten that without getting in trouble with the law*. And she gets mad over the smallest little things too. The oldest child (7 years old) stays at his great-grandparents and the mother hardly ever sees him, and when she does, she just takes him off shopping and does whatever with him & he comes back a totally different kid. Very hyper and doesn't want to do as he is told (and he can). She takes the youngest (5 years old) out on occasion with her late at night to a friends house and doesn't come home until at least 11pm (and the kid has school in the mornings). So late to where the kid gets in the bed late and they keep him out of school because he doesn't get enough sleep. And don't even get me started about their financial situation...They get 2 SS disability checks for the kids...my grandparents (who takes care of the oldest child) doesn't get but maybe $100, if they're lucky, out of the $700 check every month and he doesn't even live with his brother and parents. The $1300 or so that's left ($500 goes on bills so it's really $800 left after the bills) is gone by the time the end of the 1st week in the month comes around and she has to beg her parents for money for food b/c she wastes the food stamp money on junk and they maybe have food for 2 weeks out of the month (and they get plenty of food stamp money for the whole family). She works a part time job too, she makes about $150 a week. With a house paid for, cars paid for, only gotta pay for the basics like water, car insurance, heat & power, she ends up broke and we don't know where the money goes. Is this really neglect on the youngest child? or on the oldest child too? This has to be emotionally traumatizing to the little one hearing all of the cussing and fighting all the time & him getting yelled at all the time. He can't talk so he can't really tell us how he feels. How could I prove the mother and/or father unfit to where the kids would be put somewhere where I know they will be emotionally and physically safe? It's safe to say that my brother's wife is a total nutjob and doesn't want to accept responsibilities as a parent and just wants to do what she wants to spite what anyone else, especially her kids, wants. They are being investigated as we speak, and they have only been required to have psych evaluations and drug testing...and probably some parenting classes. She doesn't take the meds because she hasn't been prescribed any recently so there is the proof right there. And thanks for the advice, I'm going to start writing down the things she does so the next time I see the Social Services lady, I can show her the things that this mother has done so she can have some clue with what she's dealing with and how to go about dealing with it.

My father-in-law lives with us and has bad neovascular glaucoma (our main concern) among other health problems. We have exhausted ourselves trying to find him any health insurance. A)Since he has been to the doctors for his glaucoma it is now considered a "pre existing condition" and all insurances we've found won't cover it. B)The insurance's we HAVE found are about $450/month with $3K deductible, $650/month for $1K deductible. Our "pipe-dream" insurance would be something that would cover EVERYTHING including his pre existing condition at a reasonable monthly rate(stop laughing, I said it was a "pipe-dream"). Right now though we would honestly be happy with an insurance that would at least cover everything else and we'll just have to handle the glaucoma problems as we can. He is on disability but does not qualify for medicaid. He will be getting medicare in approx. 2 years due to being on disability. I'm not asking for handouts or charity so please don't feel like that's what we're doing. We are just drained and exhausted and wondering if anybody knows of insurance that is actually affordable or if this is just reality and the only choice we have. Thank you for taking the time to read this and I hope some of you out there can help us.

My former mother in law thinks I should let her claim my children as dependents on her tax return as well as claim their exemption. I told my former mother in law HELL NO! After all the crap you put me through last year, your lucky I even let my children talk to you. This woman is unbelievable. At my husbands wake, she said and I quote, "When am I going to get MY 50%, of MY sons life insurance." I told her then and there she only getting 10%, and the rest was for me and MY children. She exploded with anger, and told me that she would sue me for her 50%. He didn't give it to her, because we have I have 3 children. Then in December of 2009, she tried to get custody my children. She claimed I was keeping her from seeing them. When in actuality I had made 7 offers in 2009, for her to come here to AZ to see my children. Plus I had records of me sending emails, pictures, and correspondence between me and my former mother in law. Heck I even offered to pay for flight, hotel, and a rental car, and each time she said, "Bring my grandchildren here." Well that was not going to happen. My son is in year round school, and my twin girls are to little to travel. Besides that, I have 2 jobs, and I'm going to school myself. Oh did I also mention that on monday she informs me in an email, that she's going to be put on permanent disability, and she expects me to pay off her $37,000 of debt? Because she says "I'm greedy with HER sons money." My former mother in law received $40,000 last February, and that was more then enough money to pay off her debts. Why does she think she gets more? Now it's her "brilliant" plan to ask me to claim my children on her tax return. That's never going to happen. UGH! I am so tired of her! How can I stop her from harassaing me? I the ONLY reason why I allow her contact with me is because of my children. I want her to have a relationship with them, but it's getting to the point, that I don't want her to have any communication with me or my children. I need help please. My former mil does not my childrens ssn. all she knows is their birthdates. Oh I've been saving the communication between her, and me for years. The judge in the custody case advised me to not allow her access to my children. It came out in court, that the only reason why she took me to court in the first place, was to gain control of my childrens trust funds and my retirement accounts and college fund. She's a greedy hag! Heck, in her complaint she even wanted child support. Never gonna happen. I've got my ducks in a row!

I've been a widow for a year now. When my husband was killed in the middle east, I decided to set aside certain portions of the life insurance policies for certain things. I went to the local JC, and earned 2 certificates, that have allowed me to find gainful employment working from home, and at a local restaurant. I earn about $1500-$1900 a week between both jobs. Along with working 2 jobs, I am a full-time student, and I am also the very proud mom of 3 wonderful children. One of my children has very mild autism, who requires very expensive therapy, that my insurance only covers a portion of. My other two children are 14 months old. I received an email from my former mother-in-law, informing me that she has been put on permanent disability. She said she wants $39,000 of my husbands life insurance money, to pay off her debts. Her exact words we're, " I am expect you to take care of my debts with MY sons life insurance money. Your the one who is rich now." I laughed, and this is the email this email back to her: " I am not paying your debts. Those debts are YOUR responsibility NOT MINE! You owed us $8,000 when he died, what makes you think I'm giving you anymore money?! All you ever did was take, take, take! You created the debt you take care of it. I am also furious that you had the gall, to ask my autistic child about the money. You made my child cry! I'm done with this! If you or your daughter say one more nasty thing to me or mention money again, I will do as the judge from the custody case suggested, and NOT allow you anymore contact. I will not discuss this with you again." Has anyyone been in a situation like mine? Please no rude answers.

Ok am 32 weeks pregnant with my third child, I live in the state of New Jersey and by law am entitled to 12 weeks which are parted as four weeks before due date and six weeks after, which are going to be paid to me by the Temporary Insurance Disability program of the state of New Jersey, but I just found out that you are also entitled to 12 weeks family leave in the state of New Jersey, have in mind this is not maternity leave is call family leave, So does anyone knows if i could take my maternity leave and after those 12 weeks are gone i could get another 12 weeks as family leave with pay?

Am on medical leave thru Feb 4 due to hysterectomy. Disability is paid by private insurance provided by employer. PROBLEM. If my doctor releases me back to work on Jan 25 (surgery was done on Jan 8 and this OBGYN said only need 2 wks off of work) However, Disability feels it is a one month leave and approved me to Feb 4. If doctor releases me on Jan 25th, can my employer fire me for not returning to work until Feb 4th? Don't want to return 2 work in the 2 weeks b/c my job is very heavy lifting and a lot of walking and unpacking pallets in steel toed shoes. SOMEONE HELP

A Disability insurance company charges so much for a policy, lets about 1300 a year. Now lets say someone pays into this policy for about 15 years. Now this person becomes disabled, and despite many doctors saying she is disabled, the company refuses to pay out the policy, only doing so under legal action. Now they give this person a lawyer and sue social security for current and past benefits. These past benefits come in a lump sum that is paid to the insured person, who has to pay taxes on it, yet the insurance company demands every sent of that money be paid to them. I have read that insurance law mandates that only so much money can be made when paying out a policy. Actually receiving the benefits in this case would cost the person several thousand in taxes, that they no longer have the money to pay with. I have read about unfair contract law, is this covered? Does this violate insurance law? What are the rights of this person? And who the hell to I contact to get it brought to public knowledge (like the news) that insurance companies can receive checks of 30k directly from the government, and never lose a single penny, even in their worst case scenario??

I am amongst thousands of American people suffering from depression. It started a few months after I finished my time in the military. I'm just finding much help through the VA and not only that, but I'm worried if I seek government assistance on getting some help, that it may effect my chances of getting a high security job or law enforcement or a government job in the future. My wife says I can go through the VA for help, but I don't think so, Since one I only did 4 honorable years and two they never mentioned it in TAP class. Also I never had a problem with serious problem with depression in the military that I could file for disability for. I don't have health insurance and the places I've called are asking for a ridiculous amount money just to be seen. I never was in a combat situation and I do not suffer from PTSD. Is there any help out there for veterans that are seeking help as far as mental health goes?

Divorced 5 yrs ago and by my own mistake I never thought to take my ex off my insurance, my boss is now holding this against me from either stating I am no longer and employee so that I can file for my umemployment. I am out on sick leave with doctors excuses and my boss is also refusing to sign my short term disability form he has also showed my dr.'s excuses to all the other employees stating that they are fake (which they are not) and the insurance company is sending out a packet giving us the chance to remove any dependents we should'nt have on our policy. My question is, is this legal what my boss is doing and do I have any rights in this matter?There was no attempt to defraud we never seperated and thought we were common law married.

I am totally sick of England it is boring everyone is the same complaining and being negative, the taxes are to high (because most people get disability allowance) and all the other law's are stupid. Car insurance is sky high compared to other countrys where it is cheap (for some one of 18years old to insure a car) the music taste is awful, and most people my age are chav's which are people who lack english grammar, claim off the goverment and socialise in big groups thinking there big. These are only some of the reasons why i want to leave.

I recently resigned from a position in California to take a position in Seattle, WA. The position at the new company ended up falling through. This was after I had relocated to the area and moved into our new house. I am 4 months pregnant and have insurance coverage for the remainder of my pregnancy and for a year after the baby is born. However, I am now showing and having A LOT of trouble getting a job. I am more than qualified for the positions I'm applying - I know no one wants to hire a pregnant woman knowing she'll be on maternity leave in a few months. Since I resigned from my position in CA, I don't believe I'm eligible for unemployment. I have 2.5 years of taxed income in CA. Since I never held a position in WA, I'm not eligible here for sure. I thought maybe I would be eligible for disability for some of the pregnancy related issues I've had: debilitating headaches, memory loss (if you think pregnancy doesn't cause those things in the second trimester, look it up, it does!) plus the fact no one wants to hire a pregnant woman. I have been paying SSI for 16 years through my paycheck and I do have a monthly disability amount I am entitled to if I am in fact disabled. My brother in law works for the company I was going to be working for, so I thought there would be no problem at all. I got royally screwed. I know that. Please do not respond if you're looking to boost your ego and lecture me on the choices I should have made. I have learned a lesson from this and it sucks! I have been diagnosed with Shingles, and in my case this includes debilitating pain. The magnitude of pain medication required for me to function makes it impossible for me to work, or drive, or even stay awake for more than 3 to 4 hours at a time. In addition, I will soon have a rash of blisters which will cause me to be contagious, possibly spreading chicken pox to anyone who has never had it before. I have a 40 hour a week job as a night auditor for a fairly small hotel. I do not have health insurance from them, and I cannot be without my paycheck during this time. My research indicates that I will be communicable for up to 3 weeks, but that this pain my proceed and follow the break of rash for up to a month on both sides. So its possible that I will find myself unable to work for up to 2 months. Does anyone know if there is any way I can get temporary disability benefits to cover for my lost time at work? And if my job will be protected by law if I have to spend that much time away from it?

Resolved Question: Depression, medical insurance and college?

I have a daughter who will be 20 in December. She is in community college and my husband's insurance plan (through his job) has been covering her while she is enrolled with 12 credit hours or more (until she's 23). She is diagnosed with depression and is in regular weekly therapy and takes medication. Her grade point average is low and she struggles in some of her classes due to a mild learning disability. The therapist says she needs to take only a couple of classes a semester and strongly recommends that she cuts down to that. I checked with the insurance and they said they have their rules and 12 credit hours is the absolute minimum - - - - without that, she will be dropped from my husband's insurance, but we do have the option of COBRA (which is expensive). Taking out another plan with a different company worries me since she is already diagnosed with depression. They will charge a lot more for premiums, won't they? Is there any way around this situation? If the doctor says she needs to cut down to 2 classes and she is still our dependent, it looks like there should be some kind of law that would make them cover her. What are the options?

If your answer is "Yes, private companies would still write health insurance policies", then please tell me, "Why would they?" Once the rules change so that companies writing new policies have to write them for all applicants including those with pre-existing illness and disability, is that really insurance? Isn't that just harnessing up the shareholders of the corporation to pay the ongoing costs of the applicant with an existing illness of disability? Why would the shareholders to that? What would be in their heads? What would their business model be? Maybe something like "Oh yes, we get to pay the costs of this applicant's illness or disability, and look how much money we will be able to give to help that applicant. Then we can fail to breakeven, and become bankrupt and see our shares go to zero value, oh that would be fun, how wonderful!" When I got my MBA, I never saw a company with a business model like that. AIG may have had that, but they weren't doing it on purpose. Keep in mind that after the rules change, the old policies can stay in place. The old "book" of existing contracts can become the entire insurance business of the corporation. As long as they don't write new policies, they don't have to take all comers and insure people with pre-existing illness or pre-existing disability. They don't have to go into the charitable payment for sick people business, which doesn't seem a very smart business model for a profit seeking corporation. Ceasing writing new health insurance won't put these companies out of business, but continuing to do so surely will. So, they will apply their talents to other forms of risk-related trading. The Cap and Trade Bill, if it is enacted into law will create a vast market for pollution permissions. These will be actively bought and sold by firms that have experience in forward projection of financial values -- like health insurance companies. It's an Enron style business. That's the Bad Business Model company, and it would work by massive draws on the Federal Treasury until the moment when Congress realizes that it made a huge mistake, and that the Federal government is bankrupt because of operating a business that is well and truly not sensible. When would that happen? It would only take about two years for the Congress to figure this out. What would they do? They would have to close down the public option companies. So what then? Then nobody can get health insurance from any source. You mean the private corporations would not get back into that business? Right, I don't think they would. Once burned, twice shy. I have Group Health Insurance through my employer, a large university. I am under 65 and on long-term disability. The insurance is a high-deductible plan. The deductible is $1400 and the out-of-pocket max is $3000. Once the deductible is met, the insurance pays 80% of costs. I am considering signing up for Medicare Part D to help with my prescription costs until I reach my Group Health Insurance plan's out-of-pocket max. My Group Health Insurance will be primary and Medicare will be secondary. I understand from taking in massive quantities of reading on medicare.gov that this means my claims are subject to MSP laws. I have not been able to determine what, specifically, these MSP laws entail. 1. How will Medicare calculate its payments? 2. How will Medicare calculate the beginning of the "donut hole"? I work best with examples, so let's say that I sign up for a fictitious, simplified Medicare Part D plan that has a $0 deductible and a $30 copayment on every single medication. We'll pretend every drug is on the plan's formulary, there are no quantity limits, and that both Medicare and the Group Health Insurance pay on the basis of retail cost (there are no negotiated discounts). I fill a prescription in January, before I have met my Group Health Insurance (GHI) plan's deductible. The retail cost of the drug is $100. $100 (retail cost) - $0 (GHI payment) - $30 (copayment) = $70 paid by Medicare. Right? Assume I fill $1300 in additional prescriptions in January, thus meeting the GHI $1400 deductible ($100 + $1300). $1400 is also applied toward the "Donut Hole" in January. In February, I fill another $100 prescription. $100 (retail cost) - $80 (GHI payment) = $20. Method 1: Medicare would have paid $70 had I not had the GHI. Therefore, they will pay $70 or the amount left, whichever is less. They pay $20, and my responsibility is $0. Method 2: GHI has already paid more than Medicare would have paid. In effect, my GHI has met Medicare's "obligation," so Medicare pays $0. My responsibility is $20. Which method does Medicare use to calculate its payment? And how much "progress" did I make toward the "Donut Hole" as a result of this transaction--$100 (full cost of prescription), or $20 (amount left after GHI pays its share)?

I have a buddy who's Homeowners Insurance dropped him because he does not have central heat and air. His insurance company told him that this is a new law passed by the insurance commission. Yet, get this, he called the commission and they tell him their is no such law. He has called several homeowners insurance companies and they all tell him the same thing. Now the inspectors are telling him that if he does not get homeowners insurance they can condemn his home. He has called his congressman and different state agencies, he cannot seem to get anywhere with them. Anyone have any ideas I might can give him of who he might can contact about this? He is on disability, which really limits him financially. He lives in the State of Georgia. Wondering if anyone else who maybe in this state have ever heard of this? Yeah, Charles C, if you read my question you will see that my friend call the commission and they told him their is no such law. But, the insurance companies are telling him this and they informed him that is the reason they dropped him.

My mother is in the late stages of breast and bone cancer and is completely un-able to work her job as a high-school administrative assistant. After 3 months of being on paid sick leave the distrcit sent her a notice that she no longer holds her former position. They said they couldn't keep a temp in it and had to fill it with someone who could do the job full time without issue. They havent let her know yet if she has any job to return to in december when she is able to work again. I'm worried about her losing her health insurance as well as possibly taking a massive salary cut. I know this probably isn't illegal - just really shiesty of them to do this. But I was hoping maybe there would be some type a law out there that would help her. Any advice is highly appreciated. I should add that she has tenure and is in the NJ teachers union.

With medical costs taking a greater and greater percentage of our incomes, when will the breaking point come? With more and more people going uninsured, whether by choice or because the cost for insurance is out of reach, how can our government survive? Since our laws prohibit turning away emergency care for anybody who walks through the hospital doors, someone has to end up paying those bills. Many people are struggling to merely pay their mortgages or rent, let alone save cash for that $50,000-$100,000 hospital bill that comes in the mail after some accident or extended hospital stays. The uninsured might often find that it's easier to declare bankruptcy, kicking the burden right back to the American taxpayer. And for the uninsured with jobs, sure, if a judgment is placed against them, the medical bills can be garnished from their wages. (Exceptions are: North Carolina, South Carolina, Texas and Pennsylvania) But then legal costs pile on top of medical costs and large medical bills will still go unpaid. That does not even include the costs of deferring care for disease. People who are diagnosed with serious illnesses can end up being disabled because they are not getting the care they need or perhaps don't even know they have a serious illness until it is symptomatic because they do not get routine checkups. Once they're on disability, we will be paying even more than we would have if they had been able to get preventative and necessary care. It seems to me that our money would be better spent to keep people healthy, working, and paying taxes than it would be to let their medical conditions deteriorate to the point of disability. IF we did not already have laws stating that hospitals must render care, that people can shift their debt to the government through bankruptcy, or that people can collect disability and welfare, our current system might be sustainable. But unless these policies are reversed, how will our country sustain itself with our current system? Memphis--insurance companies are profitable only by collecting more in premiums than they pay in claims. It's the UNprofitable people who are getting kicked back to the taxpayers. That is unsustainable and is, in effect, subsidizing the health care industry. The government is already heavily involved in paying for these problems, but it's the insurance companies that are receiving payments from health care. The Dark Knight--increasing revenue is the only way to pay for increasing expenses. With our current system, tax increases are inevitable. Omega57--although I'm not sure if the proposed bills would make things worse, a single payer (Medicare for all ) system seems more logical to me. It is a political hot potato, just like deportation for illegal immigrants was 30-40 years ago when it actually would have been a viable option, but it seems much more straightforward than what is happening right now.

Michigan is a no fault insurance state. They force you to have medical and work loss coverage in the event of an accident taking away your health or an ability to work. You can coordinate with existing medical or work loss (disability) insurance to save money. Does anyone know if there are any mandates set for work loss benefits for a homemaker? The law forces me to carry work loss benefits for my wife, who is a homemaker and receives no income, however, it feels to me like I am paying premiums on coverage from which we would never - God forbid - receive any benefit.

The following are some of the benefits the couple would use during their lives together, or if one part of the couple becomes incapacitated/dies: • the ability to file joint income tax with the IRS • exemption from paying federal tax on employer-provided health insurance for a spouse • benefits for the spouse of a military veteran. • inheritance tax exemptions on property the couple owns jointly • social security benefits for the surviving spouse • apply for US citizenship if you are married to a US citizen It is a shame that after all the trials & tribulations this country has been through with discrimination/unequal treatment of people based on religion, race/skin color, nationality, gender, veteran status, disability, or social status, we haven’t learned from past mistakes. Once again, this country is discriminating against another group of taxpaying, law abiding citizens who are contributing members to our society. 2 consenting adults REGARDLESS of sex should be allowed to marry as long as they meet their state's regulation for marriage. Yet even when they DO, our federal government STILL denies them the full benefits of marriage that are automatically bestowed on straight married couples. Same-Sex marriage is a complicated issue because it has different layers to it. First, people need to understand that PEOPLE ARE BORN GAY!! Secondly, not everyone in the U.S. believes in the Bible. Third, our nation was built on the separation of church & state. (Your average ignorant person that hardly has any contact with gay people or is unaware of it tend to have an issue with the first two). And lastly, people need to understand that everyone should have the same basic rights like the pursuit of happiness and for many people that means the right to get married and have a family. Gay marriage for me personally isn't just about falling in love with man & having a family. Since the age of 4 I've known I was meant to have a loving & fulfilling relationship with another man the same way a young girl would. For me, gay marriage isn't about filing taxes with your spouse, getting work benefits, along with 1,500 other rights. Its about continuing the legacy of marriage & love my parents have blessed me with as a child and doing so in a way that meets my own emotional & physiological needs. And also living a happy life & helping others the way GOD created me to do so.

Voting Question: PA, termination of employment?

Background, My father in law has been out of work since late may due Pulmonary Fibrosis, a lung condition. He has been placed on the lung transplant list, and the pulmonologist told him not to work. The general practitioners at Allegheny General said he could return to work. He has been following the specialist's advice. He is on temporary disability. He has been working as an injection foamer in a refrigerator factory for 36 years. The chemicals he uses these days supposedly could not cause his illness. But we have no idea about the other compounds he has used over the years. Today they informed him that starting tomorrow he is no longer employed, and does not have any benefits, including his medical insurance. Because he did not come back to work. This factory has no union. Question: I personally think this cannot be legal, since he is under doctor's orders. Any body know what exactly his rights would be in this case. No they are in Jefferson county. When he was really ill they had to send him to AG in order to treat him enough to insure he lived. I would appreciate constructive input please.

My wife and I were able to successfully appeal our LTD denial. We also won our Social Security denial without a lawyer. But that leaves open what happens afterwards, what options do I have when the private insurance company behaves unprofessionally by harassing, lying, and constantly threatening you by "reviewing your disability status", month after month, considering new paperwork old because it took them weeks to get to it, etc.? Some examples: **Refusal to give me my policy, they had to be forced to do so by my former employer, only after I hired a lawyer to send them a letter demanding they provide it. **Constantly requesting "updated medical information", month after month, even though I have a letter from Social Security informing me that they are not even going review my medical condition for the next 5-7 years, due to the severity of my injury! Seems like every time I get them a report from my Dr., it takes them 4 weeks to review it and then it's old news and it starts again! **They lied and sent me a letter that they were going to reduce my monthly benefits dollar for dollar because of my daughter's Social Security benefits.I had to hire an attorney to review the contract, send a letter that it was not legal to do so, then they sent me a letter apologizing for their "mistake". I can go on and on, and that's just since last august! Am I protected from this abuse by the ADA or Bad Faith Provisions in NJ, or any other laws or regulations? So you consider it an "inconvenience" that they tried to steal my benefits, refused to provide a policy, even though I am injured and in chronic pain? What good are bad faith laws? Thanks

Why do you think health care is so expensive? I think health care is so expensive because of government laws. My father used to work for a Health Insurance company. We were talking and he said that some of the rules that the Fed has on Insurance drives the prices to be so high. He said that on many occasions he talked to middle aged woman who wanted health insurance say that they weren't going to have anymore children but the law required them to get maternity coverage, which was 1/3 of the price! Also the government has laws that states that health insurance has to coverage people with certain types of disabilities. When i say this, i don't mean that i don't think people with disabilities should not be covered, because I know that other insurance companies would cover those certain types of people. But there is a lack of them because of government requirements. You know, not being able to turn anyone down for coverage, have money requirements, yada, yada. Most people can't deal with the hassle when opening up an insurance companies. Thay why most health insurance agencies are 75-150 years old. Plus, there is this crap about interstate commerce. Which means you can't buy health insurance in another state. You tellin' me, that if they are offering cheaper, and just good healthcare in Pennsylvania i can't get it because I live New York because of interstate commerce. Your Thoughts

I have worked for a MAJOR company for just under a year. Since I started I have dealt with workplace harassment. It started out with a sort of workplace bullying and with each passing day it progressively got worse and worse. I have taken notes from day 1 about the things going on. Besides the obvious third party sexual harassment, work place bullying, and unprofessional behavior there has been several violations of the law and of the company code of conduct. I made several report inside my office to all levels of management; first my immediate supervisor then her supervisor and then her supervisor...nothing was done. Finally I reported it to HR and the next day I received a threat from one of the employees via internet communication (the threat was made during working hours I was off work that day but the employee who threatened me was not). I did a screen print and saved it to a word document (I doubled clicked on my lap top clock to pop up the clock in the screen before I did the screen print to show the time and date of the screen print). I have been in and out of the doctor because of this. My doctor diagnosed me with anxiety and depression as a result of this. My weight has yo-yo'ed, I have constant headaches and nausea, I get shaky, I just burst into tears over the slightest things (I started crying over a Rice Crispy commercial) and I'm not an emotional person at all and no I'm not pregnant. HR refused to relocate me to a different office (there are 16 offices in the county I work in) during the investigation. I told them I feared for my saftey due to the threats and they said they cannot relocate me because if they did it for me they could do it for anyone and as of right now all I have are allegations. I told them I had notes, proof of conversations, proof of the threat; they still said if you don't go to work you will be fired. I talked to my doctor and he agrees my symptoms are due to stress from this whole ongoing harassment and situation. So he put me on temporary disability. Well my last paycheck was only 75% of my normal salary. Turns out my "coding" was changed to part time the day after I reported the harassment and when I called to find out about my pay they also told me "oh also as a part time employee you aren't eligible for short term disability pay". They also told me my manager has to open a claim to get me back pay for the hours I worked and didn't get paid. I asked my manager to open a claim but she didn't and now she is on vacation. All I wanted was to be able to go to work and do my job without being harassed and now all these problems have started...what am I supposed to do? I can't afford an attorney I'm not getting paid at the moment! To summarize: They violated the whistleblower confidentiality They changed me from a full time status to part time status without consent or even notification so they don't have to pay me short term disability They are making me pay out of pocket for my medical bills as apart of my disability claim (they are not allowing me to use my insurance) They are not protecting me under the whistleblower law They aren't paying me for hours worked

I am literally in totally shock. last night my husband received a phone call from his dad at about 3 in the morning saying he needed a ride home and that he was at his friends house. So my husband and I jumped up left to go pick up. when we got there his truck, his friends truck and her mobile home had all been run into, both cars being totaled, and there was a big black pickup facing the cars, with a smashed in front bumper and his front left tire was off. supposedly the next door neighbor was coming home with a few buddys in the car drunk, and was driving like an idiot through the trailer park, and lost control and hit both cars and his next door neighbors home. my father in law was leaving to come home but had only made it on the porch with his friend and her daughter behind him when it happened, all three of them saw this man get out,and walk over to his home and shut the door. they called the cops, but my husband and i got there first. at first they seemed to be on our side, then after about 5 cops were there, they walked over to the guys house and had him come out on the porch and talk to them. at first the guy claimed his truck had been stolen, then later claimed he had let a buddy borrow it. (keep in mind there was 3 witnesses who watched him get out of the truck) by the end of the ordeal the cops and admitted to us that he was drunk, told us he did not have insurance (which is illegal if you don't in the state of ky) and they also found that his tags on his license plate was not the ones belonging to his truck. while all his is going on, he is calling cops over by name, talking to all of them, laughing and giggling, and so was a friend of his. well turns out the cops didn't arrest this man! and when my husband demanded to know why, they told us "they did not see him do it, therefore they cant lock him up" then when my husband brings up the no insurance, the officer says, "no one locks you up for not having insurance" and when my husband reminded him the it was illegal in our state not to have it, and that he him self had been locked up once for not having insurance, the officer laughed and said " well the cop who locked you up did you wrong" then my hubby proceeded to remind them of the "switched tags" and again the cop said " there are no rules that require you to get locked up over tags" (aka tampering with tags!!) the drunken man the absolute who time was laughing and talking with at least one officer during all this, and was even allowed to go get all the things out of his truck before they towed it away! in my opinion this man could have been locked up and charged with a number of things including, fleeing the scene, DUI, public intoxication, no insurance and tampering with tags. not to mention this guy was so drunk that he kept yelling at me asking if "i was with tim" when I asked who tim was, he yelled "the mother f*ucker who keeps cooking dope in my trailer" and when i said "i don't know who tim is" he proceeded to call me a lying b*tch etc. all while the cops were right there. and when we finally went to leave to go home, he lunged towards my father in law, yelling a bunch of none sense. again while the cops sat there. I used to believe it was made up about "crooked cops" and i am in shock. i cant believe that ordeal was handled that way, almost as if my father in law was the bad guy. turns out the drunk guy is the leader of some big bike gang around here, so now my husband and I are worried. that truck was all my father in law had. literally. and now he has nothing. the cops pretty much shrugged and said "sue him" but the guy lives in a run down trailer park (honestly worst than i have even seen" supposedly he doesn't work and gets $6oo something per month on disability. Im not sure what to do.advice please? not sure if makes a diffrence but my father in law only had liability inserance insurance*

How many of you agree Teddy truly was? In 1964, despite having just suffered significant injuries in a plan crash, Ted Kennedy stood on the floor of the US Senate and gave an impassioned speech in an effort to convince southern Democrats to end the filibuster of the Civil Rights Act that was later signed into law by President Johnson. In 1965, Ted Kennedy managed the passage of Immigration and Nationality Act, which struck down discriminatory immigration quotas which favored European immigration. Ted Kennedy amended the Voting Rights Act of 1965 to lower voting rights to 18 year olds. This laid the basis for 26th constitutional amendment - lowering the voting age from 21 to age 18. Ted Kennedy helped overhaul the passage of the 1971 National Cancer Act which gave the FDA broad authority to regulate the tobacco industry - also strengthening the National Cancer Institute. Ted Kennedy championed the 1972 Meals on Wheels Act to assist those who cannot prepare meals on their own. Ted Kennedy wrote the Refugee Act of 1980, providing a standard for allowing worldwide refugees into the country on a systematic basis for humanitarian reasons. Ted Kennedy introduced the 1980 Civil Rights for Institutionalized Persons Act which guaranteed civil rights and liberties for those living in government run institutions (the mentally ill, elderly, and incarcerated etc.) In 1985, Ted Kennedy introduced the Anti-Apartheid Act, thereby imposing economic sanctions against the racist South African regime until they reformed. The act banned American investments in South African businesses and SA product imports. It was passed by Congress despite President Reagan's veto. Ted Kennedy got the National Military Child Care Act passed. It established the United States Defense Department’s child care system. Ted Kennedy introduced the 1990 Americans With Disabilities Act and fought for its eventual passage. The act prohibits employers from discriminating in the workplace against job applicants who have a disability. ed Kennedy got the 1993 Family and Medical Leave Act passed - which allows for an employee to take a job-protected, temporary unpaid leave of absence due to a serious health condition (or the need to care for an ill family member) - that incapacitates the employee from being able to preform his/her job. Ted Kennedy co-sponsored the 1997 State Children’s Health Insurance Program (SCHIP) which now covers 10 million, poor uninsured American children. His legislative efforts led to the establishment of the 1997 Amber Alert Emergency System - now a national standard used by state authorities to locate missing/abducted and exploited children in North America. Ted Kennedy sponsored the Pension Protection Act of 2006 - it strengthened the financial condition of pension plans, improved taxpayer protections, and their transparency. Oh yeah, I forgot about the how Teddy pushed through the Federal Election Campaign Act Amendments of 1974 which limited individual donations to political campaigns and set up public financing for presidential elections.

Resolved Question: What happens to a cosigner in a car repo?

My mother/father in law recently co-signed on a car loan for their grandson. He went 3 months without paying a payment, then wrecked the car. Turns out he didn't even have insurance on the car. So now the car is totalled and they still owe $11,000 on the car. They cannot afford to make the payments on the car. They have decided to trade the 2 vehicles they own in on a new vehicle and let the totalled car get repo'd. They do not own a home or anything else of value and they are both on fixed disability income. They know they will be liable for the car loan, but can their wages be garnished? One is on SS Disability and the other is on RRB disability. What else will happen to them, other than their credit being ruined?? And what will happen to the POS grandson that caused all this mess?? I agree that someone needs to put the grandson in his place. That's part of the reason they've decided to do the repo. If they just keep making the payments, which would strain them unbelievably, then he gets off without any responsibility whatsoever. So they decided to teach him a lesson, even though it will hurt them also. His wages will be garnished, and theirs cannot. He will not pay any money any other way. They have already taken out a small loan to catch his 3 months of late payments up, and simply cannot afford to pay anymore. I encouraged him to take him to small claims court for the total of the small loan and towing expense it took to get the wrecked car into storage. I've never dealt with this, so I really don't feel comfortable advising either way tho. I like to pay my bills and keep my good name clean. :)

Does a disability insurance company have some sort of time limit to make a decision on a clam. I'm switching over from short term to long term disability. But it's been over eight months of one thing after another. They ran out of excuses to give to me why they are still reviewing the claim. Now they simply say we haven't made our decision. i'm getting to a point where i'm going to get a lawyer. BUt i don't want to because i will have to pay the lawyer a percentage of my claim. Is there some sort of state law to protect a person against insurance companies stalling on a claim. THis is crazy. hurt my back and can't do my job anymore

My wife and I went to her credit union to purchase life insurance for me because now I am disabled due to a chronic back injury. The credit union subcontracts it out, so the insurance company has a rep. there 2x a week. We met with her and she said, "sorry we can't insure you, we don't sell life insurance to people who are disabled". I explained that my disability is from a chronic injury to my back, not a life threatening illness and I have the same life expectancy as anyone else. We also told her that we needed life insurance, not health insurance! She then refused to even take our application and tried to sell us some "hospital stay insurance". In a couple of days, we spoke to management of the credit union and they said that they had no control over the insurance company policies, so we must contact the insurance company, but when I went to their website, all they have is a PO box address! (http://www.familysecurityplan.com) I just looked this up in the ADA: III-3.5000 Discrimination on the basis of association. A public accommodation may not discriminate against individuals or entities because of their known relationship or association with persons who have disabilities. This prohibition applies to cases where the public accommodation has knowledge of both the individual's disability and his or her relationship to another individual or entity. In addition to familial relationships, the prohibition covers any type of association between the individual or entity that is discriminated against and the individual or individuals with disabilities, if the discrimination is actually based on the disability. ILLUSTRATION 1: The owner of a building may not refuse to lease space to a medical facility because the facility specializes in treatment of individuals with HIV disease. ILLUSTRATION 2: If a theater refuses to admit K, an individual with cerebral palsy, as well as L (his brother) because K has cerebral palsy, the theater would be illegally discriminating against L on the basis of his association with K. III-3.11000 Insurance. Insurance offices are places of public accommodation and, as such, may not discriminate on the basis of disability in the sale of insurance contracts or in the terms or conditions of the insurance contracts they offer. Because of the nature of the insurance business, however, consideration of disability in the sale of insurance contracts does not always constitute "discrimination. " An insurer or other public accommodation may underwrite, classify, or administer risks that are based on or not inconsistent with State law, provided that such practices are not used to evade the purposes of the ADA. Thus, a public accommodation may offer a plan that limits certain kinds of coverage based on classification of risk, but may not refuse to insure, or refuse to continue to insure, or limit the amount, extent, or kind of coverage available to an individual, or charge a different rate for the same coverage solely because of a physical or mental impairment, except where the refusal, limitation, or rate differential is based on sound actuarial principles or is related to actual or reasonably anticipated experience. The ADA, therefore, does not prohibit use of legitimate actuarial considerations to justify differential treatment of individuals with disabilities in insurance. ILLUSTRATION: A person who has cerebral palsy may not be denied coverage based on disability independent of actuarial risk classification. Can a group health insurance policy have a pre-existing condition exclusion? Yes. An individual with a pre-existing condition may be denied coverage for that condition for the period specified in the policy. However, the individual cannot be denied coverage for illness or injuries unrelated to the pre-existing condition. Can an insurance policy limit coverage for certain procedures or treatments? Yes, but it may not entirely deny coverage to a person with a disability. Does the ADA require insurance companies to provide a copy of the actuarial data on which its actions are based at the request of the applicant? The ADA does not require it. Under some State regulatory schemes, however, insurers may have to file such actuarial information with the State regulatory agency, and this information may be obtainable at the State level. Does the ADA apply only to life and health insurance? No. Although life and health insurance are the areas where the ADA will have its greatest application, the ADA applies equally to unjustified discrimination in all types of insurance, including property and casualty insurance, provided by public accommodations. Have my rights been violated under the ADA per above? I need life insurance because I no longer have it since I lost my job.

Voting Question: Can you help me with my emancipation dilemma?

I’ve just turned 16 and I am pregnant. I want to move in with my boyfriend at his new apartment. He has two jobs and makes enough money to support us, but I also have a part time job. I’ve bought a car and I’ve paid for car insurance. I am ahead in high school and my plan is to obtain all of my required credits around April. Four years of my college will automatically be paid for by my Dad’s veteran disability benefits. My dad lives in Europe and he said that he would be okay with emancipation if his consent was needed. I am confident that my boyfriend and I can support our child on our own. The only problem is that I know that my mom won’t approve, especially when she finds out that I’m pregnant. When she finds out that I’m going to be having a baby she will want to try and make all my choices even more than she wants to now. If I don’t get out now and learn how to support myself before my child is born it will be a lot harder learning to support us at once. I’m sure that in court I would easily be able to be emancipated if only my mother would consent. Since she doesn’t I really don’t know how I should go about this. The laws for emancipation in the state of Alaska are •The child must be a resident of Alaska •The child has to be at least 16 years of age •The child must be living separate and apart from the parents or guardian •The child must be capable of supporting himself or herself financially and managing his or her own affairs •Each parent or guardian must consent (although there are certain exceptions) I don’t know how to go about this if I’m not already supporting myself for six months and living on my own. If I leave home my mom will call me in as a runaway. I’m assuming that the parental consent exceptions are something other than my case. On the form it really focuses on whether schooling is or will be finished, when it will be finished and how I will go about it. It asks about a job, which I already have and about my rent situation. There are also other financial questions, but I am not out on my own and able to answer these questions on the form. I’m just looking for any advice that I’m not already informed of. I want to know how someone else would go about this. I’m not going to give up on moving out and supporting myself and my child. Thank you so much for listening. My mom will always help me, but I need to learn to be responsible for myself as much as I am able. I want and answer about how I should go about the process. This is not to get away from my mom, it is to build my maturity and responsibility. In a family where I have and child I would rely on the father to be responsible, love me and be supportive. This is what I have in my boyfriend. I wouldn't be with someone without these qualities for as long as I have.
