A friend worked only 11 weeks during early 2009 earning just over ten grand. She then had a serious knee operation and went onto puny company funded 710 dollars a month short term disability for 6 months. finally, she got some unemployment payments for a few months. This was in NY State. Of course, she had a lot of out of pocket med costs for MD visits, tests, physical therapy, travel, phone, other medical payments which total up, plus some other deductibles if she files the long form with miscellaneous deductions... in NY. How does all this figure on both Federal tax returns as well as NY State tax dept. returns? Does the unemployment insurance count as regular income dollar for dollar....what about the short term disability payments? Any Special things and forms to do/use?

I have gotten a few different answers on this and its just confusing me. I am going to be receiving NY state short term disability insurance for my maternity leave. Does that start from the day I actually go into the hospital to have the baby then 6 weeks after? if I go out before the day I go into labor then do I not get paid unless I have a doctors note?Then 2nd part to that question if someone knows the answer, if I do have a doctors note to go out early would my 6 weeks start then or would I get paid for whatever time I went out early with doctors note plus the 6 weeks? I have looked online for this answer but of course NY state websites are not too helpful at all. I am going to meet with my HR rep at work next week but its been making me anxious lately not knowing about this and I only have 3 weeks to go. Your Question Why don't I get Disability? I am 42 y/o. I have a bad history of traumatic accidents throughout my life. At age 4 I was hit by a car and broke both legs and fractured my skull. I miraculously recovered from these injuries and went on to a somewhat normal childhood. I say 'somewhat' because at the time 1972, ptsd was not well defined or know about, at least I don't think it was because I recieved no psychological attention at the time. I do remember that starting school for me was really, REALLY a hard thing to do. Later on at age 16, a friend of min at the time asked me to go for a ride on his motorcycle. I was a minor at the time and didn't know about anything such as if he had a legal license or if the motorcycle was insured. It turned out he didn't have a licence and it wasn't insured and he crashed and I shattered my ankle and have nuerological problems with my foot, hammer toes.. a total nightmare. I recovered from this, but my foot has never been the same, still have hammer toes.. (what's it like to wear sandals, anyone?). Being that we were renting an apartment from the friend whose motorcycle it was my family told me not to sue the home insurance despite my attorney at the time saying we could. The lawsuit for my injuries was 3 million dollars and when the family got that letter they just about took out shotguns and threatened us. My mother and father then advised me not to sue them so I got no money for my injuries at all. Now at the age of 42 I have chronic back pain, foot pain, and I haven't been able to work since two other bad accidents in 1999 and 2002. My back is so bad that any stress or strain on it I am out of commission for sometimes more than 2 weeks. My doctor has been pumping me up on narcotics, oxycontin, oxycodone, etc.. but the doctor's reports never seem to get me disability benefits so my wife and I live in poverty, the 2002 accident happened while I was at work and workmans comp settled my claim for $500/mo. so my annual salary is $6,000.00 per year and this is all I make. My wife who is from Estonia, is illegal and we haven't had the money it would take to get her legal so we are both living in a small studio apartment and we can't get anyone to help our situation and have been living like this for 10 years. I really feel bad, I have no life, no way to make a living and no help from any agency. I have Binder & Binder but they didn't get me anything other than the usual 'Denial' letter from NY State Disability. I have been in a cycle of appeals for 10 years. I can't help but think that there are some people in prison who are living better than me, a regular guy who has been in accident's and is now just stuck like this. Can anyone help us or advise us?

Any suggestions of how to get medical treatment for right arm numbness? I broke my arm at work seven years ago. I had surgery and it has been fine with a mal union and inoperable joint that cracked into three pieces from a fixator placed incorrectly) until about two months ago- I went to a family doctor three times; he prescribed an anti anxiety med and sent me to the ER. I have progressive numbness, shooting pain from my elbow to my wrist and occasionally to my neck. My workman’s comp Dr dropped me because he does not want to deal with NY workman’s comp insurance (He is in another state and took it originally out of pity for Starting in March, In the ER three I was worked up for chest pain each time and assured my heart is great. My arm aches so bad that I cannot sleep in a bed and I take naproxen to manage the pain but is causing bruising and bleeding. I found a workman’s comp doc and had to wait a month to see him. Today I saw him. He asked for my regular insurance and stated he does not accept that company and asked if I would pay out of pocket for any portion of the bill workman’s comp does not pay. (I know this is illegal, but in NY illegal activities are not enforceable). I called the comp board today and was told that my case states my original disability was limited to just the wrist so that ortho doc would not get reimbursed for my arm pain, and I need a hearing to correct it because all my original medical visits clearly state I originally broke my arm. So my family doc keep sending me to the ER, the ER only does tests only for my heart then tells me to see a workman’s comp ortho doc. Local ortho doc’s do not want my case because it is much paperwork for little pay. One ortho doc saw me but will not do tests or treat me because he feels he will not get paid enough. My attorney needs to call a new hearing to correct the disability title. The pain and numbness is do bad, I have digressed to crying frequently, the pain & numbness is awful. I cannot get a full nights sleep and when I take the pain meds during the day, I fall asleep for an hour. Is there anyway to get treatment Daniel; I already have a ton of medical bills including an ambulance transport to rule out a heart attack. I can't afford any more incompetent doctors following protocals to get as much money as possible without any concern for treating my actually problem. These hospitals balance bill, so no matter what my insurnace pays, they have billed me at a higher rate that allows them to come after me after being paid by my insurance company. The problem with workman's comp is that the doctors cannot balance bill and cannot collect additional money using inpatient-outpatient/negociated rates/ multi billing tactics.

Here is the scenario...Mom and teen son who live with a man( roommate), have been told the room mate is leaving because he cannot afford the rent anymore. (mom pays all the bills, plus all household expenses, food, cooks and takes care of her own bills like car insurance and teenager exposes.). Apt office won't accept another room mate to finish the lease. Mom has three other options, but none of them are "for sure" or solid at the moment: 1, Live with a man who's known her 7 yrs-but it's a two family house and his aunt owns it and lives upstairs-she;s 85. He also has a 21 yr old daughter there full time, and 17 yr old son, all summer, all weekends and 4 hours everyday, after school. She really loves this man, and they met because my dad married the lady that left this man. So they are the "x's".But the house is small and very cluttered and we fear the aunt will say no. 2 there is a possible ( maybe very remote, not sure yet), that a man who heard of the situation, might want to help and get an apt here in town.He's met with mom, and is 10 yrs older, a widower, and seems very serious about offering a place to live here, while he still maintains his own house he rents in NY. Nice older man. 3a friend she's not seenfor years, male, could possibly take her, but it's out of state. They have been telephone friends mostly. She does not want to end up in some homeless shelter. She went to welfare( she is on SSI) social security disability),and she was told to wait for an eviction notice and then they will put her and son in a shelter,, and in that time, they will "help" with rent, if she finds an apartment. There is no section 8 here. What would YOU do?

Resolved Question: NY Medicaid with spend down?

I now have a spend down with Medicaid. After trying to get an answer for over two months the CDPHP representative at my local Social Security office told me I no longer have CDPHP because I have a spend down, not eligible for managed care. I was told I can still go to medical appointments I just need to give my Benefit (Medicaid) card instead of the CDPHP one that I used to give them. I am disabled and unable to work, receiving Social Security Disability (SSD) for my only income. I have to pay $140 a month to be able to have Medicaid. SSD wants me to call them and tell them what my bills are (rent, phone, heat, electric ect) so that they can give me more money a month. This would just mean any extra money they give me would go right to Medicaid. I have to see a social worker/therapist/psychiatrist at least once every two weeks. I also need to see a nurse practitioner/psychologist around once a month, some times more. I have 7 prescriptions for medication that I need to get filled every month. Does anyone know what if any the co payments are for these things with just having Medicaid? Not that I would see any point in co payments being that Medicaid would just but them towards my next months spend down. When/if I have to be emitted for inpatient care due to mental health I have to pay the spend down for 6 months ahead for it to be covered by Medicaid. Is this before or after I get emitted? If it is before, how do they expect me to get down to their office and pay it when I need to be in the hospital? Also, I doubt it but is there any health insurance out there that I could get myself that would cost me less than what Medicaid is but still cover everything I need? Thank you for any information you can give me. I would call Medicaid to ask them but I'm sure that the lovely people here would answer me long before I would get even one answer from Medicaid being that it took me 2 months just to get them to tell me I don't have CDPHP any more. Thanks everyone!!! Oh and the 6 months payment is because I pay my spend down at the start of each month directly to Medicaid, like you would for the premium of "normal" insurance. The "deductible" for a hospital stay is equivalent to 6 months of my spend down payments.

I am disabled. I have received meds for three years. I have to use a pharmacy 60 miles away so the dr's wife can fax them (the prescriptions) then send the hard copy.(it's always mailed,never given to patient) Only one pharmacist is allowed to fill all prescriptions from one particular dr. If this particular pharmacist is not in, then you wait till she comes in to work ,so you have to wait for meds even longer. This pharmacy told me my insurance quit paying for a certain pres., so they had to compound it so it would only cost me $100. a month instead of $400.00 a month. Then I was told insurance will pay for it if it has a certain compound in it. Next month comes, ins. will not pay. Dr calls head pharm, says get her (me ) my med., and it came in mail next day. (I have to have my prescriptions mailed to me) (Why can't I choose a pharmacy in town? not a dr or dr.'s wife's choice?) so when my pres came overnight, I thought the pharmacy got my ins to pay for it. No. Ins. co. was billed,(medicare and Ahcccs) and I did not pay for it, no credit card was charged either., then I was told by my dr. he did it as a favor to me. keep my mouth shut. Now I want to change pharmacies so it's close to me and so I don't drive 120 miles round trip for co-pays or they won't mail it. I call head pharmacist today , tell him I do not want to use their pharmacy anymore bec ause my meds are getting later and later every month, and I got hung up on, then dr. wife calls me, jumps on me for "jumping' on Pharmacist, and said well months change?? and you'll get two of your meds(that are past due) tomorrow in mail. Sounds like somebody is getting kick backs and feel they are above the law. Please help. Just got a call from pharmacy, and after three years of not charging co-pays when mailing prescriptions out, this month I have had to come up with $1.10 per pres. without Notice, so If my friend had not a card to call into pharmacy to pay $2.00 today, I would have to drive 120miles round trip , 2/12 hrsdriving time, hurting ,to get ny meds or wait more days.. I have clinical depression, p.t.s.d. and physical injuries that require these meds. If I had not decided to cut back on the amount of meds I'm taking I would have been in severe withdrawals, probably died. Plese help. I am calling the American' s with disabilities act, I thought it was against the law to treat the disabled this way!!! Thank you for your help.

am currently living in Burlington VT and on disability and medicaid due to a motor neuron disease (ALS) I am going to be moving to New York State in June to be closer to family. Will this affect my ability to still receive medicaid? I currently live with my fiance' and 3 children and receive constant medical care due to my condition. When in NY...i will be living with my fiance' and 3 kids as well...so the living arrangements (household income) will be the same, but just in a different state. I was injured on the job and am now seeking workers compensation. The accident took place in Oct. of '08 and I have a WC hearing coming up pretty soon. However, right now I should be receiving Disability, but the insurance company cannot begin making payments until my former employer completes their portion of the DB450 claim form. The form was first sent to them at the end of Oct. and the director only answered 3 of the 17 questions (he did not put my wages which is the single most important thing the insurance company needs). I do not wish to have any contact with the employer because they used false allegations to fire me on the day that I asked for the WC forms and I do want my contacting them to be an opportunity to make any more. Is it legal for them not to properly fill out this form? It seems spiteful and wrong. They also never did pay overtime and now it seems as if they have something to hide. Any suggestions>

I coming with evidences of documentation of what happening to even naturalized but foreign born people when I do not know what the mock is behinf that, the Hillary Clinron, or what... ...I became 62 yrs old, and they stopped my Social Security checks of disability, earlier my medicaid. (I do not suspect Hillary C. directly, in NY a "native american " looking woman reported me first, asked me about if I have life insurance, etc.)

I was just wondering if someone could help me out with the NYS Disability Insurance. I work in NYS but I have never seen on my pay stub NYSDI taken out of my check...I have something that shows as NY OASDI/EE. I thought in NYS you had to have NYSDI. I am concerened because I am pregnant and will go out on maternity leave this year. My company doesn't offer anything and I was expecting to collect on NYSDI. Could someone please help clarify this for me? I am not talking about health insurance...we are fully covered for that. Everyone that I have known to get pregnant and have the baby...after the baby was born they were able to collect NYSDI because it is considered a temporary disability as you cannot work. I was just wondering if the NY OASI was the same thing so that I know that I am covered.

I work for a small company in ny, and the owner hired his family (mother in law,& sister in law) to work for him. He is paying min wage but he is paying them off the books. He cut my hours to give more to them, and I have been working there a long time. I found out the sister in law was recieving disability, county paid health insurance, and food stamps, so I reported them. A workercame upt but they all lied and basically got away with it. I called them again and they said they need proof, so I sent in their timecards, but now they say they need more proof. What could I send them, what exactly do they want. this is so wrong, why are they not invesigating it? The sister in law who is recieving SSI, food stamps, county health insurance, and some sort of progra where they pay for her apartment, is able to work--she is working 30+ hours a week standing on her feet and moving most of the time She told me her self she is not disablied. She was in a car crash years ago and need it then, but has admitted she has since healed and is able to work but does not want to because they do not know she is better, and they will keep sending her check and paying for everything. Why does the county not care? This is a huge waste of my tax paying money, and I know people who could truely use SSI but can not get on. My friends moom has cancer and can not get it because the system is so full

I am a former NYS Government employee who retired this year as a result of an on-the-job ( Workers Comp) injury . I am Disabled & am Wheelchair Bound, but have limited ambulation with a Walker. As a retiree; I am paying a monthly premium of approximately $ 250. for COBRA Health Insurance coverage for my family & myself. I have been informed that my COBRA coverage will be extended for an extra 6 months up to a period of 2 years from my reirement date because I am on Social Security Disability. I have also been informed that I will receive Medicare commencing 2 years from the inception date of my Social Security Benefits. I will receive Medicare 3 months before my COBRA expires-However; I am concerned that the rest of my family will not have Health Insurance coverage after my COBRA expires ?- Can I obtain Heath Insurance coverage for my family either through Medicare or an extension of COBRA after it expires ? - As a retiree,can I retain my NYS Life Insurance indefinitely ? - Thank

My Mom age 59 lives on her own, has no health insurance, can't hold a job (She is a nurse RN), She has no money and needs major help. BPD has ruined every relationship she had with her family. I'm the only one she can turn to. She lives in FL and I live in NY. I keep telling her that she needs to get on disability... but she said that's near to impossible. She can't come live with me because she would just rip my marriage apart. I can't afford to support her although she expects me to. Are there any organizations out there that can help her with treatment and maybe help her get financial help? She has no problem getting jobs.. The problem is she doesn't last longer than 3 weeks. Right now she has no job and her rent is due. She has no maybe $40 that's it.. no retirement, no savings.. her credit is terrible and her car is about to be repossed. I'm worried she'll get evicted and have to live in a shelter.. this will devistate her.. Any help would be GREATLY appreciated

I just finished my training, and the "probationary period" w/ this co. is technically 6 months (that is, I'm fully trained and can work unsupervised (it's a BIG insurance co./you've probably seen their ads on tv) but I think that refers more to their training policy than their actual hire/fire procedures. I was fired 15 yrs ago for being pregnant but the EEOC told me that unless the co. hired at least 15 ppl (they only hired maybe 2 or 3) I had no recourse but otherwise I would have. What are my rights, how do I approach my supervisor when I start showing (which won't be long) and how do I find out from HR what my maternity leave/disability options are without them asking me "why do you want to know?

Is this a good policy? My broker says it's better than Aflac because it's non-cancellable and lasts until I'm 65 should I need it. He said that as a white-collar professional, long-term disability ins is important for me which I can understand since I need to protect my income. He gave me a health questionnaire to fill out. I'm not totally comfortable filling it out - is it standard to fill one out and do a physical exam and bloodwork like they want? If I take this policy, does this long-term disability ins totally replace Aflac (I have a 6 month policy through my employer). Does it make a difference that my broker is a proponent of the Lifetime Economic Acceleration Process (LEAP), which I think is hooey (I know LEAP is a subsidiary of Guardan)? Aside from that his description of Guardian disability insurance makes it seem like a good choice among several (Met, NY, Std).

Resolved Question: Is there a disability law in NY how many weeks out of work after a C-section?

My disability insurance is only paying for 6 weeks after my c-section. My doctor says I should get 8 weeks. Does anyone know of a law in new york state that might support this? I would like to appeal their decision.

No health insurance and there's an accident and now many medical bills, not long term and no permanent disabilities, but something that may accumulate to thousands of dollars in medical bills, is there any way that you can get (free) coverage through the Medicaid program or some other program?

I am running a small - medium size healthcare staffing company that provides LPNs and RNs to Nursing Homes in NY Metro area. Each nurse works as a 1099. One of the requirements is that before they can start on their assignments with our clients, they are required to fill out an Independent Contractor's agreement that states they are responsible for their own worker's Comp and Disability Insurance. 6 Months ago, while on an assignment, a nurse fell at the client's facility on the wet (from rain) floor and hurt her leg. She Then proceeded to file a Worker's Comp claim through the client. After I learned of this, I spoke to the client and the client agreed to put the claim through his facility's insurance (WC). Now I am getting a letter from Worker's Comp asking me how how my company has no Worker's Comp Ins. Should I be worried? If yes, do I need a specialized attorney? Do you know a good one in NY area?

Complaints of alien abduction, which were probally a technology oriented transit delusion, all came from the western US, especially the Mojave, and NW Mexico, and SW Canada. A few were reported in upstate NY in a forest-like area. One was reported in the UK. And why haven't we heard anything about people getting abducted by aliens for about 20 years? Do insurance companies have to pay for therapy for abductees? Does it qualify them for Disability?
