can you be thrown in jail if you got no assets debt collectors can take. i work a low income job less then 30 hours a week. i receive disability income and i don't make enough to pay my debt and support me myself. i got a call from a collection agency that if i don't pay they will get a lawsuit against me. i don't make enough and now im scared that i will go to jail if i got no assets to take. if i got no assets what do they do? how do debt collectors view what assets i have if i have any at all. all i got is a car i bought locally and is paid in full but i think this is exempt as well as my disability income i researched this this is my research Many people are in fact in a position where they cannot be collected on. If incase you are disabled and/or on limited income, chances are that they can get a judgment but will never be able to collect the debt. There is also a Federal minimum wage pay per week (around 30 hours), which if you make below, they cannot collect. For example, if you make a minimum wage of $5.80 per hour, times 30 hours, comes to $174 per week or $702 /month. If you make equal to that or less they cannot lay a hand on you. Money that is in IRA’s, custodial accounts, trusts, annuities, and insurance contracts are often untouchable.Can my personal property be seized by a Marshal? The following kinds of personal property are exempt from debt collection and cannot be seized: * Household goods, like furniture, clothing, and appliances * One television * Radio * Personal items like wedding ring or watch * If a computer or car is indispensable to your work, they can be exempt as "tools of trade i got both but are they still exempt. i need honest answers i live in Idaho

Hello, I would like to know if I will qualify for disability and or welfair AND how do i apply (should i get a lawyer?) . I am 20 years old and was diagnosed with bipolar about 5 years ago. I have always taken medication for depression bipolar and add. In the past 2-3 years of my working experience I have not been able to hold a job down for more than 1 year, in most cases 3-6 months. I am getting to the point where I am being forced to leave my mothers house due to personal problems..I am 20 years old and ready to get my life started...I am still on my parents health insurance wich is running out soon so I am not going to be able to pay for insurance..rent..car..or my perscription wich are NEEDED. someone please help who has experience with this...I am clueless, and need answers please how does the cut work for the lawyer?

I'm about to file a complaint of discrimination against my employer. Have sent an email into the EEOC, asking for further info, will call on Monday when they open. Situation is this (sorry it's long, tried to stick to just the facts): Hired as contract work, 20-30 hours a week, driving and setting up events for catering. Worked for a month or two, was going great, boss was talking about getting me benefits, and having me be solely in charge of the driving. Added to insurance, all that. Had a seizure on the job. Was checked out medically, no epilepsy, no diabetes, zero cause to think i'd have another. Fault was thought to be bad diet, low blood sugar that day. Implicitly explained that there's no reason to think I would have another. 1 out of 10 people have a one-time seizure in their life, often for no reason to be found. Instantly, taken off insurance and driving by employer. For Nov and Dec, I was scheduled for a total of 5 hours, each month. Boss has talked to me several times about how "not everyone can be hired" (as he has hired several more people after me, to do my job), and it's unfortunate that they can't give me more hours. They had roughly 50 events scheduled, for a total of 400-500 hours available. So, it is my belief that I have a pretty strong case. All this came about due to an accident, and there's no grounds to think it will happen again. And yet, they haven't terminated me, just tried to get me to quit by cutting my hours, etc. And apparently, he's been telling other employees that I have asthma or something. I'm a U.S. Marine. I'm in great shape. No idea where he's coming up with that. I understand that it's recommended to file a complaint, before a personal suit. Supposing they attempt to settle, or it does go to suit, what would YOU consider a reasonable amount? Right now, I feel I'm due at least the value of the missed wages. Which is roughly $4,000. The fact that he's telling my co-workers lies about my condition, I would think is a separate charge of slander. It's hurting my reputation with the company, drastically. I'm thinking somewhere around $6-8000 or so, total. I'm no gold digger. I'm not after fortunes. It's just been highly insulting, and difficult financially. And completely unjustified. Should I talk to my boss before filing the complaint, or simply file? I doubt I'll get an actual lawyer answering, but as an opinion purely, do you feel I've got a good chance at winning this? mnwomen; I recommend you go read the laws on disability discrimination. To quote the EEOC page: "Disability discrimination also occurs when a covered employer or other entity treats an applicant or employee less favorably because she has a history of a disability or because she is believed to have a physical or mental impairment that is not transitory (lasting or expected to last six months or less) and minor (even if she does not have such an impairment)." I am specifically being treated less favorably, because I am BELIEVED to have a disability. Nothing says you have to actually have a disability. Just being treated differently, because they think you have one, is discrimination. Thanks for an uneducated answer. Anyone else? KW: My case is that my CONTRACT has been broken by my employer, on the terms that he THINKS I have epilepsy. How did you miss the whole point? And how is the employer in the right for cutting my hours, on false grounds? And in the right to tell my co-workers I have things wrong with me that are not true? And in GA, one seizure does not constitute epilepsy, restrictions, or anything else. Maybe I should just talk to a lawyer. You guys seem to be clueless.

I grew up with a young woman who was, well, just a little odd. At least, that's what people said. Nice people did, anyway. Most of the apes we went to high-school with said she was effing weird, and made her the target of their own personal insecurities and tormented her mercilessly. Now: she was not "slow" - in fact she was quite smart. Just that... well, she didn't know how to act. And, she would utterly collapse in the face of any sort of confrontational situation. I was the one who was always sheilding her and protecting her all through high-school. Her family was a perfectly normal couple - when I was a teen I turned to them for a place to feel safe and loved when I was going through "teen stuff," so, they can't be the "source" of her "differentness." I'm sure her disorder is organic. In fact recently I've had it pointed out to me that certain body movements are an indicator of mental illness and I was all "OMG that's just how 'Mary' walked!" The concept of "autism" came out about a decade after she and I survived high-school, and in fact she was once concerned that she might be high-functioning autistic, because she is so smart. But, somehow, the sypmptoms didn't seem to fit. I've met a lot of autistic people since then and she is nothing like them. Also she is very outgoing and caring about other people, so that doesn't fit the whole autism scenario, either. Her main symptom is that she will collapse into jelly if put into a confrontational situation. She also walks really "funny," but not because of any motor impairment. It's purely a behavior. The kind of walk film-makers use to show that someone is "a bit titched," only, she does it for real, and doesn't realize she's doing anything different. She could never hold a job because, should her boss or a customer yell at her, she would end up in a hospital needing sedation. Yet, she's able to cook and clean and take care of herself, so she can't legally (or according to insurance policies) be institutionalized. She has NO delusions or anything like that. She's a Good Person, kind and outgoing and very intelligent, yet... something is missing - something which affects her ability to manage in the real world. Currently she lives with a mentally ill (paranoid schizophrenic - officially diagnosed and therefore receiving disability income) husband and attends adult day care counselling therapy sesssions, but, in her socioeconomic bracket, that is probably as advanced as her diagnosis or level of care will ever get. My question is: I have never, ever seen or heard of a "Diagnosis" for a person like this, nor have I ever met another person who is anything like this. Is there a name for what she has, or is she just...something totally unique? I guess all I'm really looking for is a Label. Which, I guess, is fundamentally wrong anyway. But the question bugs me sometimes. Anyone out there ever meet anyone like this, and have they ever heard of a name for this sort of disorder?

The healthcare conundrum: Private matter? Or public? I am fortunate to have healthcare options provided by my employer. My premium of about $160/mo is higher than if I was to purchase a basic private health insurance from Anthem or Blueshield, etc, but I get comprehensive coverage and need only to worry over the average of $25 copays per doctor's visit. Unfortunately, our group health insurance does not make any empathetic cuts to spousal premiums. If I was to have our insurance cover him, we would be looking at a $300+/month expense that comes straight out of my pocket. My spouse, however, is like many other self-employed contractors who prefers to forgo private insurance and risk going about day to day without what I call a peace of mind. What of the inconceivable medical bill in the case of a freak accident? As a spouse/family member, I would have to assume the responsibility of covering his expenses in case of disability and lack of funds from his personal account (if no other party is held liable). What do you think? Do you think health insurance is overvalued? Can we really live normal lives without it?

I don't think its appropriate to tell her all my business but I also think she should know that I'm trying. I have several learning and emotional disabilities. I have another Major class that I am currently failing. I may not graduate. My fiance just dumped me. I just found out I lost my scholarship. I have no money to pay my rent. My health insurance just got canceled so I'm off my meds. All these thing distract me from class. I don't know what to write in this paper. I think it all sounds bit too personal. How should I write it?

I had an accident about 2 years ago and i already told my insurance about it. Insurance company already setteled for property damage. so my question is, am i responsible to get my own lawyer when the plaintiff filed a lawsuit on me for personal injury? or is it the insurance company's problem??? cuz i got a summon from a court and I already forwarded it to my insurance company?? i just got infuriated when a summon arrived on the last day of 2nd anniversary of the accident. theyre asking for a lot of compensations, which is more than what I have in my liablity insurance. The accident involved three cars. I was yielding, I thought the up coming car was far enough. Unfortunately it was not far enough and it hit her car which hit the third person's (who filed the lawsuit) car. The person who filed a lawsuit had minor damage to his car and didn't go to the hospital immediately. He is askin for disabilities, hospital fees and so on.... I need opinions about whether I need to hire my own lawyer or not. Should I just rely on Insurance Company lawyer to defend? Any suggestion will be helpful. Thank you. Thakkar

Voting Question: Question about Short Term Disability & Maternity Leave?

So, I work for a small company (5 employees) and they do not currently offer short term disability. I am interested in getting it, as my hubby and I plan on getting pregnant within the next few months. I just raised the question at our company meeting this morning and I was told to send the owner an email to look into it. His email is a black hole of nothingness so I don't expect to get anything done that way. So I have started filling the whole "Send me a quote" things on the website to have them sent to myself. What I need from you guys is some info/feedback which companies do/don't offer the following: 1) Maternity Coverage 2) At what % of income 3) for how long? DLA threat and AA threat What exactly is the Green Paper about? The green paper is about the problem of paying for care as the UK’s population ages. It proposes setting up a National Care Service, like the National Health Service, to provide a universal system of care throughout the UK. Much of the document is devoted to discussing how to pay for this service, including: making everyone pay a flat rate of £25,000 before or after they die, whether they ever need care or not; or making everyone over retirement age pay into an insurance scheme; or making people pay for part of their care depending on their means. This is in addition to the proposal to take disability benefits off claimants and hand them over to the care service. The National Care Service would only deal with your care needs. If you had to go into residential care you would still have to pay for accommodation, heating, lighting, food, clothes, toiletries, etc. But at least under this system everyone would have the right to the care they need, even though it might mean getting rid of disability benefits, right? No, not at all. Everyone would have the right to have their care needs assessed but only the most severely disabled would actually receive any care. The way it would work is that under the National Care Service everyone in the UK would have their care needs assessed using the same criteria wherever they live. This might be done by a national body – it’s easy to imagine a company like Atos who currently do benefits medicals being employed to do the assessments – or it might be done by local social services departments all working to the same system. As a result of the assessment, some people would be awarded a ‘personal budget’ – a cash amount that could be used to meet their needs. Many people, however, would receive no care whatsoever, because their care needs would be below the threshold set nationally or by individual local authorities. For example you might be assessed as needing help with washing, dressing and undressing because of arthritis. But you’d be very unlikely to actually get this help from the National Care Service. Resources would be reserved for those with higher needs than yours. One of the concerns of disability agencies, including RNIB, is that many people who are currently entitled to DLA or AA would not be entitled to a personal budget from the National Care Service. At the moment, most local authorities do not currently provide help for people who ‘only’ need help with washing and dressing. Still, those with the highest care needs would be able to purchase whatever they wanted with their personal budget, wouldn’t they? No, not at all. How the budget would be spent would depend on what agreement individuals were able to reach with a social worker. If you have ME/CFS, for example, you may rely on your DLA or AA to pay for alternative therapies such as acupuncture, homeopathy, herbalism or chiropractice or you may use it to pay for dietary supplements that you know help you. However, professionals may dismiss these as quack remedies and you may not be able to use your personal budget for those sort of things. It wouldn’t be your cash to spend as you choose, in the way that DLA and AA are. Won’t there be some sort of transitional relief for current claimants? Yes, there may be. But you might not like it. One proposal is to ensure that all current claimants get a care package of at least the value of their current disability benefits payments. But the amounts paid for DLA and AA wouldn’t get you very much care. Middle rate care DLA and lower rate AA are worth £47.10 a week, for example. This might get you help with washing and dressing in the morning and getting into bed at night for two, or at the most three days a week. The other four or five days you’d have to manage alone. If your care needs are at night, your benefits would pay for one night a week for someone to sleep in your house and not even a single night for someone to stay awake. Lower rate DLA wouldn’t pay for even two hours of care a week. In fact it might not get you any hours at all, but instead be used to pay for aids or adaptations. I get SSI and am going to start working in 3 weeks. The max I can make is 900 a month. I don't have any bills , rent, car payment or insurance. Just a cell phone bill, has and I believe I'm going to be paying 50 a month for my insurance. I'm also begining to declare bankruptcy for all the time when my disability landed me in the hospital. I don't know anything about personal fiance. Now that I will be having some money come in what should I do? I read everyone,no matter how poor, should have a financial advisor. I also read you can get one from your bank or some are free because they plan on making money from you. I don't know anyone in this area to recomend me to sumbody. When I start working will they have something (401k?) to invest in. What's the difference between a 401k and Roth IRA? If I put money in savings should it be where I have my bank account is or somewhere that makes money off the money you put in savings. I ordered Suzie Ormans book about being young etc and read another financial one. I just don't want to broke and homeless when I'm older. SSI could never support me. I have help with for now. I just don't know what to invest in or save for my future because I don't have much money although I have virtually no bills or debt (in a few months) but won''t have good credit. Thanks

As a teacher, we don't pay into the State Disability Insurance, which I think is really dumb. I talked to the Human Resources lady at my work. She said they will use my sick/personal day first (which is only 10 days), and then i will get unpaid work for 6 weeks. If I choose to do the Family Leave Act for up to 12 weeks, but also still unpaid. Do I have any other options to get help to get paid? Or basically does my husband and I have to start saving as much as we can to survive the time I am off work? My husband will be the only source of income when the baby comes, and it's not much at all. Yes, I have been sick a lot on and off the 4 years I've been with the school. I finally had surgery. I had to use up my sick days. So, the only sick days I have will be the upcoming year. People who pay into SDI, and get pregnant are technically on disability from my understanding.

Obama says National Healthcare plan is not personal to him. Would that be because when asked to commit to enrolling himself and family to the National Healthcare Insurance if approved refused to do so? Having had a major illness and having family and friends who have had major life threatening illnesses I know how much a quick medical response makes and how PERSONAL the choice of life versus disability or death due to delay in getting medical care is? Think about your life, family, and friends. Is healthcare PERSONAL to you? Why then does Mr. Obama feel that Nationalizing Healthcare is impersonal and not worth taking the time to get the bill right, but rather rush it through congress? Democrats? Is healthcare personal, shouldn't we take the time to get the right bill not the quickest bill?

I worked in healthcare and personal injury work for 13 years in the US. 100% of the people involved in PI lawsuits are uninsured - otherwise they'd just have their insurance pay for their care and that would be it! If we had insurance and social security like disability insurance in Europe there would be no lawsuits here at all - just like in Europe. PJ - if both people are insured the two companies send each other the bills and they haggle it out - there is no lawsuit!!! People being uninsured is what feeds the trial lawyer lawsuit problem, and that's what drives rates up! Jewels - "Europe is a tiny country"? But it sounds like you're talking about Stalinist Russia - which is probably what Fox TV told you Europe is like.

I'm thinking of signing up for their personal disability protector (short term disability insurance) and personal accident indemnity plan the next time they come to my employer. Right now I wish I had signed up earlier this year as my doctor's won allow me to go back to work until we figure out what is wrong with my right hip. I'm on crutches and generally taking it easy on myself right now. But I miss being at work a lot right now. The only other problem I have with not having Aflac is that I have plenty of heath insurance,Blue Cross, Medicare and Medicaid. But not anything from Aflac!!

So I'm quickly approaching the point where the company that currently covers all my transition needs can give me the bump off if I don't do something. I'll be turning 21 in a mere two months and unless I give them sufficient proof that I have a pre-existing condition I'll be on my own for the cost of testosterone and visits to my counselor (aka my ticket to the head of the line for all transition resources)... Has anyone ever gone to their insurance company with G.I.D as a reason for them to continue coverage (Canada or Ontario in particular)? I'm technically on the plan still as a dependent of my father (it's his work coverage) which is why they boot you at 21 if you aren't in school full time (and I just graduated)... or at 25 if you are deemed worthy. I keep thinking I would only qualify if I had a really serious condition that required an excessive amount of care.... I don't think that of transitioning and feel like I'd be cheating to use G.I.D (and that I'd be buying into the "oh, I am ill" BS). I think it's meant for adult children who have conditions where they cannot care for themselves... like physical or mental disabilities... Would being trans keep me covered until I am 25? Also... would playing my "G.I.D card" now mess me up for personal insurance coverage later on in life? Would I be shooting myself in the foot? A million thanks for any information, suggestions, or stories on how you managed to beat the system (or even how the system caught you) while transitioning. A few hundred laughs in your face to the trolls, haters, and people who feel the need to tell me that being trans is "wrong".

Hi I was wondering if you would be able to look at a brief summary of my family situation and give me some suggestions.I want to get insurance but can u recomment some changes in what I presently have. I thank you. I am married and have 3 childern (ages 9, 12, and 16) I just bought a waterfront home which is valued at 500,000 with a 300,000 mortgage. My jewrely is about 10,000. We have 3 cars a 2004 BMW, a 2002 Lexus and 1997 Jeep Wrangler. My husband works at a large manufacturing firm and earns about 125 K. I run a day care center from my home and earn about 45K. I don't have any employees. My kids all go to private school - which costs me about 25 a year. We honestly have no savings or investments and almost no discretionary income at the end of the month. ( which is a main reason I am writing this!) I met with a financial planner and they suggested on purchasing a 50,000 variable life policy for each of us as an investement. I get a disability check in the mail (im 18) The check is in my moms name The check helps us get extra things we want see my meds and doctor visits are what cost the most and now that I have better insurance (sorry cant spell) it is easy to pay the medical bills and yes we do need some of the money (we dont have it just cause we want it) but would it be rude to ask my mom for like $50-$100 of my check? because I need to save money to make it to london (personal reason)

I need to know how I can help myself financially because I have a condition that has prevented me from working and being reliable. Condition: Since I was 14 (now 27) I have had mitral valve prolapse, which isn't too serious but in my case its noticeable and is a trigger for a domino effect symptoms. Mitral valve is when a valve in my heart pumps backwards and for me I feel a very hard pounding and sometimes it pumps a bit faster than normal which makes my breath hard to catch. This always triggers a response of my adrenal gland. The doctors told me that the heart prolapse triggers my adrenal gland to over produce adrenaline. This makes me very dizzy to where its very hard to focus and I can barely walk. I have had this happen in a car before and the dizziness impairs me from driving. Usually all of this causes me to have a migraine and then I'm not well for hours and sometimes days. Doctors recently told me that I should work around this because there is no pill that will make it go away. I have had all sorts of misdiagnosed medicines through the years because doctors did not know exactly what it was at first. I had cardiologists have me on Inderol and other palpitation medications. I had neurologists put me on Zoloft and every kind of anxiety type medication which I was taken off of because it didn't seem to be helping for years. The whole "spell" that I like to call it usually happens as soon as I open my eyes in the morning but can happen throughout the whole day. It always happens when anything changes in my body. If I'm sick with the flu/cold or menstruating it happens even more. Doctors say its triggered when anything is off in my body. We have tried eating as soon as I wake up, different sleep patters, different diet, exercise and been tested to see if its low blood sugar. One thing I think could be related is my spine. I have sculiosis (curvature of the spine) and my back seems to be out a lot. Back and neck pain. I would go to a chiropractor but I do not have the finances to do so. I am a very hard worker and have had experience as a personal assistant & sales & am currently a piano teacher with less than a handful of students. I like to think I am reliable because I want to work but my condition makes it impossible to get to work sometimes. This has caused a vicious cycle of me being the perfect worker until I have had too many sick days and I end up finding something else because it is unfair to my employer who needs someone to work. Luckily I have never been fired over it but it has definitely put hinderances on my life, goals, and finances. At the moment I have less than $10 & no proper clothing but my poor fiance is helping with food. My car payment is on hold and my parents are unable to help me in any way. I am in the process of trying to find a legit home job where I can make regular money like $200-300 a week. Its hard to find a legit home based job that you do not have to invest in. I just found out there are virtual assistants that work from home though. I am looking into it but even though I'm in Los Angeles its a hard position to come by. A couple of years ago I applied for disability and got rejected because I didn't have recent pay stubs. A lot of my jobs were personal assistant jobs so I didn't have record of work. Resolved Question: How does workers comp affect my BI claim in an auto accident?

I was recently involved in an auto accident where the other party was determined to be at fault. I was operating a work vehicle in the course of employment at the time of the accident. I suffered a knee injury due to being broadsided on my driver's side door where my knee was located at the time of impact. This accident occurred in the state of California. I understand that my worker's comp insurance (through my employer) will present a lien for all of their specials paid. If the total value of my general damages exceeds the at fault party's liability coverage, who has the right of first recovery? Do I collect my general damages first, or am I obligated to repay the worker's comp lien? Would my personal auto policy's UIM coverage act as excess if the at fault party has minimum limits? Finally, does my compensation for general damages by the at fault party's insurance company affect worker's comp damages if there is a permanent disability? Sorry, there are a lot of questions. Wilfredo Tiongco Ngo, 51, and his wife, Maria Teresa Lamayo Ngo, 49, co-owners of A-Plus Planning Services in Orange County in California, also face a stiff fine of $10.75 million or “twice the gross gain or gross loss resulting from the offenses, which ever is greatest." Sentencing has been scheduled for September 21 by Judge David O. Carter of the US District Court of Central District of California in Los Angeles. The couple were charged in August last year with a four-count indictment, including: 1. Inducing aliens to reside in the United States; 2. Knowingly employing illegal aliens; 3. Knowingly harboring illegal aliens; and 4. Counseling persons to engage in marriage fraud. When they were arraigned by US Magistrate Judge Marc L. Goldman last August 25, 2008, the Ngo's and their co-accused, Gicela Sarabia, 43, pleaded not guilty of the charges against them. Last month, however, the couple pleaded guilty of Count No. 1 as part of a plea bargain. Sarabia, who was charged with inducing aliens to reside in the US and knowingly hiring illegal aliens, has not yet copped a plea. It was not known if the Philippine Consulate in Los Angeles was advised by US immigration authorities of the arrest of the Ngos and the couple's right to seek help from the Philippine Consulate as mandated by the 1963 Vienna Convention on Consular Relations of which both the Philippines and the United States are signatories. The Ngos are Philippine citizens. A-Plus Senior Planning Services is a private health care agency that provides basic care to the elderly in assisted-living facilities in Orange County since January 2005. It has 200 employees, half of them undocumented. It has 65 employees, 20 with non-immigrant visas, with denied political asylum, engaged in fraudulent sham marriage or had been previously ordered deported. The agency was originally named Better Care Solutions. When the company was audited, it changed its name to A-Plus Senior Planning Services. The agreement was agreed and accepted by Mieke I. Biesheuvel, assistant US attorney on behalf of Thomas P. O’Brien, US attorney for the Central District of California, and Robert A. Van Hoy, counsel for defendant Maria Teresa Lamayo Ngo, and Mark W. Fredrick, counsel for Wilfredo Tiongco Ngo. The alleged illegal activity of A-Plus was found out when two Filipino caregivers filed unemployment claims in July and October of 2006 with the California Employment Development Division. 1. Does anybody out there have links to personal injury attorneys for me in the Dallas area? 2. Has anybody out there (in the Dallas area) suffered from an on-site, work related injury/temporary or permanent disability? (if so, please tell me your story) Long story short. In a menagerie of owners, general contractors, subcontractors, and employees I was injured while performing my job. I worked through the injury (in much pain) in order to complete the project. Yes, the injury was reported to my employer...the subcontractor. He did not suggest, advise, or otherwise seem to terribly concerned about getting me medical attention. Now I know why. He had no Workman's Compensation insurance. Here's the problem: My employer is based out of Colorado. Also my home state. PI attorneys here in CO will not touch my case because the injury occurred across state lines. So, I have 2 options once I can find an attorney in the Dallas area. 1. File a claim/suit against the general contractor. 2. File a claim/suit against the owners of the property. Please help. I'm in constant pain and have not held / cannot hold a job since Nov. 17th, 2008. To add insult to injury, my former employer has not responded to any of my phone calls or emails re: said injury. Here's the deal. My husband has been on SSI for 8 yrs (we just got married) and it's due to a disability he has (rare bone disease) but he's not on SSDI, he's on SSI, So, now that we're married, I want to file my taxes & he's freaking out saying they're going to stop his benefits. Apparently he didn't think about this before we got married. So, he's telling me to lie & file as "single" but I can't do that. Doesn't the IRS know I'm married? He thinks if I file as married, that will put a red flag on him. I want to file as "married, filing separately" but he thinks any mention of marriage & my income will stop his benefits entirely. Is this true? Should I contact a tax attorney? My husband says it doesn't matter how much or how little I make, that if I file as married, I'm screwing him over. How is that? I'm so confused. I won't LIE to the government & put myself in that situation. If I'm married & file saying I'm single, wouldn't I get in trouble for that? I don't make that much. Around $40,000 to $50,000 per year & live in a high priced area in CA so that's not a lot around here. We have totally separate finances as well. I pay my own share of rent, car, utilities, insurance, all my personal stuff, cell phone, credit cards, etc. What should I do? He's furious with me that I might file as married & make him a target.

The leader of the nation's largest veterans organization says he is "deeply disappointed and concerned" after a meeting with President Obama today to discuss a proposal to force private insurance companies to pay for the treatment of military veterans who have suffered service-connected disabilities and injuries. The Obama administration recently revealed a plan to require private insurance carriers to reimburse the Department of Veterans Affairs (VA) in such cases. "It became apparent during our discussion today that the President intends to move forward with this unreasonable plan," said Commander David K. Rehbein of The American Legion. "He says he is looking to generate $540-million by this method, but refused to hear arguments about the moral and government-avowed obligations that would be compromised by it." The Commander, clearly angered as he emerged from the session said, "This reimbursement plan would be inconsistent with the mandate ' to care for him who shall have borne the battle' given that the United States government sent members of the armed forces into harm's way, and not private insurance companies. I say again that The American Legion does not and will not support any plan that seeks to bill a veteran for treatment of a service connected disability at the very agency that was created to treat the unique need of America's veterans!" Commander Rehbein was among a group of senior officials from veterans service organizations joining the President, White House Chief of Staff Rahm Emmanuel, Secretary of Veterans Affairs Eric Shinseki and Steven Kosiak, the overseer of defense spending at the Office of Management and Budget (OMB). The group's early afternoon conversation at The White House was precipitated by a letter of protest presented to the President earlier this month. The letter, co-signed by Commander Rehbein and the heads of ten colleague organizations, read, in part, " There is simply no logical explanation for billing a veteran's personal insurance for care that the VA has a responsibility to provide. While we understand the fiscal difficulties this country faces right now, placing the burden of those fiscal problems on the men and women who have already sacrificed a great deal for this country is unconscionable." Commander Rehbein reiterated points made last week in testimony to both House and Senate Veterans' Affairs Committees. It was stated then that The American Legion believes that the reimbursement plan would be inconsistent with the mandate that VA treat service-connected injuries and disabilities given that the United States government sends members of the armed forces into harm's way, and not private insurance companies. The proposed requirement for these companies to reimburse the VA would not only be unfair, says the Legion, but would have an adverse impact on service-connected disabled veterans and their families. The Legion argues that, depending on the severity of the medical conditions involved, maximum insurance coverage limits could be reached through treatment of the veteran's condition alone. That would leave the rest of the family without health care benefits. The Legion also points out that many health insurance companies require deductibles to be paid before any benefits are covered. Additionally, the Legion is concerned that private insurance premiums would be elevated to cover service-connected disabled veterans and their families, especially if the veterans are self-employed or employed in small businesses unable to negotiate more favorable across-the-board insurance policy pricing. The American Legion also believes that some employers, especially small businesses, would be reluctant to hire veterans with service-connected disabilities due to the negative impact their employment might have on obtaining and financing company health care benefits. "I got the distinct impression that the only hope of this plan not being enacted," said Commander Rehbein, "is for an alternative plan to be developed that would generate the desired $540-million in revenue. The American Legion has long advocated for Medicare reimbursement to VA for the treatment of veterans. This, we believe, would more easily meet the President's financial goal. I was hired by a company in Florida 1.5 yrs ago while I was living there, but recently I've moved to Oregon and they're allowing me to work remotely. However, they prefer that I become an independent contractor 1099 due to the benefits change and paper work involved. I would like to know how to calculate my hourly rate because currently I have Health Insurance, Dental, Short Term Disability, 2 weeks vacation, 2 personal days, 5 sick days. Should I take all of this into consideration as to what my hourly rate should be? I know I will get my own LLC and I plan on hiring an accountant once that step comes, but right now all accountants are too busy with tax season to sit with me. Thank you in advance.

I know a woman who has worked hard all of her life but has always lived paycheck to paycheck. She doesn't have any insurance because her job doesn't offer it and her husband can't work because he is disabled (paraplegic), but he does collect disability. They have been married for 7 years and she wants kids so bad but they have never been able to have any. She is a wonderful woman, age 35, awesome with kids, and her husband is great with them as well. She is fairly well educated, mainly through personal studies, but she has gone to college as well, but did not graduate because she has narcolepsy and it made it hard for her to keep on going, because she had to work at the same time, although she did very well while she went. She and her husband help out others in her community with other children and have helped many of the other children to go to college and and the like. She just loves kids and wants one of her own so bad, but they just cannot afford health insurance for her let alone fertility treatment. She was almost in tears when we talked about it. When I talked to her, she admitted to me that if she ever did get lucky and have a child, they would probably need government assistance to afford the child though. I just felt so sorry for this woman. Even though her and her husband would need assistance from the government if they did have a child, I already know that she would be a better mother to the child than I have seen personally with people who do have alot of money. So my question is, in a situation like this, do you think she should have a child or get assistance to have a child or do you think that because they are poor that they should suffer the cruel punishment of never experiencing having offspring? Boo and sham, I would have said I agreed with you before I really got to know this woman, but I have changed my views since I met her. She is the most pleasant woman I have ever met. Kids in the community just love her, including my own. She is not bitter because she cannot have children, but I can see the longing in eyes and in her heart. It just kills me to see her in that kind of pain. Bash, that is a great idea, and I had actually suggested that, but she was concerned that they would not award her custody of a foster child because her husband is disabled, and she is the one who works. Not to say that her husband is useless, he would be a great father as well, and I know he would do as much as he could, but he might be limited in what kind of care he could give. And what of those people who are terrible parents but who can financially give their kids everything they ever wanted....are they deserving to be parents.....believe me they are out there. I have seen them with my own eyes. Catherine, and what would you consider a decent life? A family who can buy their child a car for their 16th birthday? A family who can afford to go on vacation once a year? These things are not required for a child to grow up happy, educated and well adjusted. If he had this surgery he would be laid up for awhile is there government assistance for something like this or should I look into a personal insurance with disability?

Hi: My wife's request to sign up for short-term disability through her employee benefits was denied by the insurance company due to a pre-existing condition she was born with. Are there any company's that issue short-term disabilities privately in situations like this? or because she was denied by one, she'll be denied by all (assuming there are even companies that provide individual policies). Reason being, we have been considering having a kid and are worried if she has complications during the pregnancy that require bed rest. She has enough personal time saved up to cover 3 months after the pregnancy, but we are worried if something should happen prior to giving birth how we will make ends meet if she is out of work for an unexpected 1-3 months prior. Any recommendations or insight is appreciated. Thanks for the reply. I do not believe her condition would have any relation to pregnancy, made worse, etc. She was born with the Hepatitus B virus, but does not require any medication such as interferon (don't know exact spelling) as of yet .This was why she was denied short-term disability according to the letter we received.

I am still young and confused about how I should register. Here are my views. After you tell me what I should register as can you tell me if you would ever support me in an election. I believe in lower taxes, I agree with a flat income tax and a flat sales tax. I also support a sales tax holiday to last thru the month of December to boost buying. I think that lower taxes and ax breaks should be used as incentives for companies to come back to the US and so that small businesses and entrepreneurs have a fair shot. I am a believer in capitalism with some regulation (health benefits, workers comp, and work hours obviously). I think that a good program would be a small business bond program where average Americans can lend money to government in secured loan with interests, so that that money can then be lent to small businesses but lenders would get money back with interest. I also believe that taxes should not control behavior but instead should be used as a way to receive revenue. On social issues. I believe that a civil union for any two consenting adults is a must but am opposed to calling it marriage because marriage is a religious ceremony. When it comes to abortion I strongly oppose it and believe that government money should not be used to fund abortions. I do believe though that it must remain legal but that people that do it should do it with their own money. I oppose GOVERNMENT funding of stem cell research and cloning. On foreign policy. I am against entangling alliances and I believe that our military resources should be used only for self-defense (Ex. 9/11). I also have my own philosophy called “western-hemispherianism”, where I think that the US should its private sector should instead negotiate and create jobs in the western hemisphere rather than in eastern countries like China and India. Doing so would weaken our political enemies and bring an end to the immigration crisis (the biggest reason why people migrate is lack of jobs). On that note I am strongly against illegal immigration. I support raids and deportation and the construction and investment in more border security. I believe in protectionist policies (tariffs) against companies that have jobs in eastern countries. On social security I oppose it except for helping those with disabilities and widows. I do not believe that retirees should be supported by the government but that they should rather have personal responsibility and save for the future. They should be able to use their money to invest how over they like. When it comes to welfare I believe that irresponsible parents and people who do not seek a job or an education. Welfare should be used and not abused. On energy I believe in investing in nuclear, clean coal, geothermal, solar, natural gas, bio-fuels, and the exploitation of OUR fossil fuels. I believe in energy independence. When it comes to health I think that workers should be able to choose to keep their own health insurance thru their jobs, purchase on their own. I also support legislation where hospitals and clinics can enlist their services in a database and where they promise to provide services to families that can prove that they have a wage of under $50,000. In exchange I would promise the hospital an annual $1 billion and clinics $4million (excludes cosmetic procedures and abortions). I support cancer research and AIDS research as well as autism research. Finally!Education. I think that the system needs to go through some serious reform. Teacher’s abilities should be tested by their respective states. States should also make legislation to not allow cell phone access in schools. They should also make contracts with internet service providers to make sure that all schools have access to the internet and that students have their textbooks. I am also a supporter of the voucher program for students who wish to apply for alternative schools. I also wish we had a program where students who graduate college/apprenticeship for example can receive a $1500 bonus after they graduate. I also think that cities should create local workshops paid by the government where students can go to and get tutoring free of charge by college students in certain fields (mathematics,literature). This could count as work study for college students while at the same time prepping elementary and high school kids. AND OF COURSE PARENTS MUST DO THEIR PART! sure unka dano

Some more specific stuff includes attending staff meetings and serve on committees. Use computers, audio-visual aids, and other equipment and materials to supplement presentations. Establish and enforce rules for behavior and procedures for maintaining order among students. Prepare students for later grades by encouraging them to explore learning opportunities and to persevere with challenging tasks. Prepare, administer, and grade tests and assignments to evaluate students' progress. Attend professional meetings, educational conferences, and teacher training workshops to maintain and improve professional competence. I am taking a personal money management class and our teacher wants us to evaluate different examples of different insurance plans. I got auto done but yet I am to find Homeowners, Health, Disability, and Life insurance. We are supposed to talk to our parents but... well my mom thinks I shouldn't share that information so I need your help! I've grown up with Epilepsy all my life and have had 2 brain surgeries to treat. While the surgery helped, I still have about 5-10 grandmal seizures a year. The seizures cause extreme migraines, amnesia, confusion, exhaustion, and muscle soreness that takes about 2-3 days to recover from. Now that I'm getting ready to graduate from college and enter the working world, I'm worried about the transition from my parents' insurance to my own and have been looking into state programs to help cover my costs while I'm in transition, but there are very little in my state for my condition. Do you think that people with Epilepsy like mine should qualify for disability benefits? Epileptics' job opportunities are limited to non-physical labor kind of work and nothing that involves driving. Also, people like me can sometimes wake up suddenly in the ER after a bad seizure and miss a week or two of their lives. Last spring during a seizure I fell and landed with my face on a curb - I got a broken nose, broken cheekbone, fractured jaw bone, black eye, 3 stitches about my left eye, and a bursted blood vessel in that eye, too. Considering all of this, do you think that people like me with 5-10 seizures a year, no personal transportation, limited opportunity, severe side effects from seizures, and many medications and doctors visits should be eligible for Disability benefits?

My idea revolves around the disabled society. A class that teaches about disabilities that is taught in the same manner as history, math, english, black history, etc. My idea is that this class be taught at levels K through 12, in the same manner that these other subject matters are taught. Some possible topics include: basic fundamentals of varying disabilities and their impacts in a disabled persons personal and family life, their habits and decisions, as well as work related issues concering the disabled. It could include ADA Guidelines and rules, disabled people in history, and in the present, who have or are making a difference (i.e. S. Hawkings, C. Reeves, M. Fox). Other topics include: Specialized equipment for the disabled, Insurance issues, medical rights, the personal economic impact of having a disability. I also think that it should highlight on myths and predujices about disabilities based on lack of knowledge and seek to enlighten those prejudices. They could also conduct expirements that allows the able-bodied to see with our eyes. Things like walking correctly with a cane, using a wheelchair in tight facilities, utilizing braces in the correct manner. Things of that nature. The ideas are endless and it would really educate the general public about disability awareness issues. I believe that this could be an important step for the disabled and abled community as a whole. How can this be implented into the school system? It most definitely was. I never had the idea before you asked your question. After thinking about it, I was surprised I've never heard the idea before. Hopefully it will inspire someone someday with the ability to implement it, to do so. We'll just have to wait and see I guess.

I have a husband whom I love very much. He and I were together many years before he decided to join the military for personal reasons. He was kicked out after roughly 1 year because of a mental disability bordering on psychosis. That entire year, plus every year since, he has been dealing with the mental agony of service, and then afterwards, the inability to cope with life in general. He has been acting out in desperation. He gets mad and breaks stuff -breaks dishes, punches walls, etc. Yesterday he threw a box at me and hit me with an ironing board while I was holding our son of 10 months. He is sick. He is very, very ill. Today he saw his first doctor to get him into treatment. We haven't had insurance before and just got him in to see someone. I can't very well live like this but if he's willing to get help, should I be patient? I promised to stand by his side through "sickness and health," and this is a bad time. I realize this is abusive every time I feel the bruises hurt. I have 3 new ones since yesterday. However, ripping our son away from his dad is wrong and leaving him when he needs me is wrong too. I am not blameless here; if I didn't antagonize him he wouldn't get to that point - but sometimes having him do his homework and go to school is dreadfully important to me. What would you do? I think I'm doing the right thing by giving him the opportunity to see a doctor before I leave. I don't want things to end. We're in our 9th year of marriage and our son loves his father. Please help (and please don't criticize me. I have enough going on). teacher, that's what happened today, though he is not committed.

I fell and broke both of my ankles in June - was off work for 12 weeks - home bound - because I couldn't put any weight on either ankles - I'm suing the company that delivered a phone book and left right on my welcome mat ... which I didn't see when I stepped out to leave my apartment to go to work - my question is this - does anyone have any idea how much money is averagely awarded in cases like this - I missed my entire summer - was off work - got paid because I had short-term disability insurance (thank God). Any comments would be greatly appreciated. Thanks!

I'm 24, & I have my BA college degree in Spanish. I can't find a job ANYWHERE for ANY position. & what makes it harder is my transportation struggle. I don't have a car, I hardly ever have any money to take the bus, etc. Some jobs require that you have a VALID TX license, insurance, & a car. & sadly, those are the jobs that pay a measly $8/hr. to be personal care attendants & stuff like that. I'm locked in a lease, I can't move anywhere else b/c of the lease issue & lack of money. I have a disability & get SSI & Social Security to survive, & I'm barely surviving. I also get food stamps. My Vocational Rehabilitation counselor doesn't want to help me at all.
